Responsible actor. Person alleging dismissal in contravention of Part 3-1, or qualifying industrial association.
Identify the effective date of the alleged dismissal. An earlier workplace complaint or the later receipt of advice is not the section 366 trigger.
Section 365 concerns dismissal disputes. Section 372 concerns a person alleging a Part 3-1 contravention who is not entitled to use section 365.
The initial Commission application is distinct from later steps after a certificate. Do not use the 21-day initial deadline as a later court or arbitration deadline.
Use this tool for an alleged dismissal in contravention of Part 3-1. The applicant may be the person or an industrial association entitled to represent that person. The tool does not decide adverse action, prohibited reasons or jurisdiction.
Fair Work Act 2009, Section 365How do I count this 21-day filing period?
- Establish day the alleged dismissal took effect.
- Confirm the applicable procedure, the place concerned and any inconsistent direction.
- Exclude the event day and count 21 calendar days.
- Check the final day against the established place, including consecutive closures.
- Complete the required lodgment and separate service steps; preserve their evidence.
Exclude the established trigger day. Count every following calendar day, including intermediate weekends and holidays. The period is not a count of business days.
If the last day is a Saturday, Sunday, public holiday or bank holiday in the place concerned, section 36 carries it to the first following day that is none of those days. Establish the place concerned. State calendars do not establish every local or conditional holiday. Unconfirmed places, conditional dates and unsupported years require review.

Fictitious example
Fictitious established event. Day the alleged dismissal took effect is Monday, October 12, 2026. One established place concerned in Sydney, New South Wales, with local holidays confirmed and no contrary direction.
| Step | What is counted | Date |

| Consecutive closed final days | One established place concerned in Sydney, New South Wales, with local holidays confirmed and no contrary direction. Exclude Friday, December 4, 2026; count 21 calendar days to Friday, December 25, 2026. The final Christmas Day, weekend and December 28 substitute holiday sequence carries the last filing day to Tuesday, December 29, 2026. | Tuesday, December 29, 2026 |

Try these dates in the calculatorWhich conditions must I check for this general protections procedure?
- Exceptional-circumstances extension
- Section 366(2) requires exceptional circumstances and consideration of delay, action disputing dismissal, prejudice, merits and fairness. Do not import the separate unfair-dismissal factor concerning later awareness as an express section 366 factor.
- Non-dismissal adverse action
- Section 366 applies to section 365 applications. This calculator does not impose that dismissal clock on a section 372 non-dismissal dispute.
- Application and acknowledgment
- Use an accepted channel and preserve its confirmation and acknowledgment. A later acknowledgment may affect proof of lodgment under the particular channel rules.
- Use this tool for an alleged dismissal in contravention of Part 3-1. The applicant may be the person or an industrial association entitled to represent that person. The tool does not decide adverse action, prohibited reasons or jurisdiction.
- The section 365 application, a section 372 non-dismissal dispute, a respondent response and post-certificate arbitration are separate acts. This page answers only the initial dismissal application deadline.

Questions about the general protections deadline
When is a general protections dismissal application due?
Does the deadline cover adverse action without dismissal?
This 21-day period covers section 365 dismissal applications. Section 372 provides a separate non-dismissal application and this tool does not calculate its full timetable.
Fair Work Act 2009, sections 365, 366 and 372Can an industrial association apply?
Section 365 allows an industrial association entitled to represent the person’s industrial interests to apply, as well as the person.
Fair Work Act 2009, sections 365 and 366Does lodging a workplace grievance restart time?
Section 366 measures from the alleged dismissal taking effect. A grievance is not an automatic new trigger. Action disputing dismissal may be relevant to an extension decision.
Fair Work Act 2009, sections 365 and 366Is the extension test identical to unfair dismissal?
No. Both use exceptional circumstances, but their express factor lists differ. Section 366(2) does not expressly list later awareness as section 394(3) does.
Fair Work Act 2009, sections 365 and 366Do state holidays matter?
They can affect the final day in the place concerned. Intermediate holidays count. A NSW holiday is not automatically a Perth holiday.
Fair Work Commission Rules 2024, r 6Is a later court application also due in 21 days?
No. Section 370 addresses the later application after a Commission certificate, with a separate 14-day period and possible court extension. Section 370(b) separately addresses applications including an interim injunction. Establish the actual route and trigger.
