When must the BC appeal book of transcripts be filed and served?

The appellant must file and serve a book of transcripts not more than 60 days after filing the notice of appeal, or after leave is granted if leave is required.

Responsible actor. The appellant preparing the book of transcripts.

The ordinary transcript clock shares the appeal record’s event branches. Identify required testimony and other necessary transcripts, the permitted preparation route and any actual dispensation.

The parties agree to omit a portion of the transcript. Rule 24(6) permits exclusion of that portion by agreement. It does not itself replace the sixty-day filing-and-service period.

How does this provision count time?

  1. The appellant preparing the book of transcripts first identifies the operative event named in r 24.
  2. Rule 24 uses sixty calendar days after the actual notice filing or required leave grant. Ordering transcripts, agreeing to exclude portions and receiving the completed book do not reset that event. Interpretation Act section 25.2(2)(a) excludes the event day.
  3. The party checks the actual granted order and the required filing or service evidence before relying on the ordinary book of transcripts branch.

Rule 24 uses sixty calendar days after the actual notice filing or required leave grant. Ordering transcripts, agreeing to exclude portions and receiving the completed book do not reset that event. Interpretation Act section 25.2(2)(a) excludes the event day.

For book of transcripts, Rule 2 extends a time for doing the act that falls or expires on a nonbusiness day to the next business day, using the actual registry-opening definition and registrar directions in Rules 1 and 83. Verify an unusual local closure separately.
