When must I appeal an income-tax confirmation or reassessment to the Tax Court of Canada?
A taxpayer who served a section 165 objection ordinarily has 90 days from the day the confirmation or reassessment notice was sent to institute the section 169 appeal. Exclude the sent day. Receipt does not restart the clock. Check the holiday rule and complete Registry filing. A missed period requires a separate section 167 application.

Which notice starts the 90-day income-tax appeal period?
A taxpayer who served a section 165 objection ordinarily has 90 days from the day the confirmation or reassessment notice was sent to institute the section 169 appeal. Exclude the sent day. Receipt does not restart the clock. Check the holiday rule and complete Registry filing. A missed period requires a separate section 167 application.
Responsible actor. The taxpayer appealing an assessment after a qualifying objection.
Identify the section 165 notice that confirms the assessment or reassesses after the objection. Establish when that notice was sent from the relevant record. A later opening or receipt date is a separate fact.
Section 169(1)(b) also permits an appeal after 90 days have elapsed following service of an objection if the Minister has not notified the taxpayer of the specified disposition. That is an alternative gateway, not a 90-day deadline measured from the original assessment or objection.
The calculator covers established event and final dates in 2026 and 2027 using the named federal holiday baseline. It does not establish notice dispatch, the original appeal expiry, a local holiday, filing acceptance or entitlement to relief. It withholds a computed and purchasable date when the statutory baseline ends on Saturday. The Court guidance describes a Saturday extension, but the reviewed statutory text does not itself create that general extension.
Income Tax Act section 169(1)How do I count 90 days without a winter pause?
- Establish the qualifying section 165 notice and its sent date.
- Exclude that day, then enumerate 90 consecutive calendar days.
- Include all intermediate weekends, holidays and the December 21 to January 7 period.
- Check the final statutory holiday, local calendar and supported coverage. Resolve a Saturday endpoint separately.
- File the notice in the appropriate procedure and preserve the Registry receipt.
Exclude the independently established sent day under Interpretation Act section 27. Count 90 consecutive days and include the last day. Do not substitute receipt or exclude the court winter period. Apply the final-holiday rule only after the full count.
Count intermediate weekends, holidays and December 21 through January 7. This statutory period has no General Procedure winter-recess pause. Interpretation Act section 26 moves a final holiday, including Sunday, to the next day that is not a holiday. Section 35(1) also recognizes qualifying provincial and civic holidays. Additional local holidays and proclamations need separate checking. Registry closure is not automatically a statutory holiday. Saturday endpoints remain unsupported pending reconciliation with the Court guidance.
Interpretation Act sections 26, 27, 28, 35(1) and 37What do independent deadline examples show?
Fictitious example
Fictitious qualifying confirmation notice sent July 8, 2026. The objection and dispatch date are independently established. No additional local holiday applies.
| Step | What is counted | Date |
|---|---|---|
| Ordinary selected branch | Exclude sent day 2026-07-08. Enumerate 90 consecutive days through 2026-10-06, including every winter holiday. No final named federal holiday adjustment is required. | Tuesday, October 6, 2026 |
| Final holiday or unsupported Saturday | Exclude sent day 2026-01-05. Enumerate 90 consecutive days through 2026-04-05, including every winter holiday. Final holidays 2026-04-05, 2026-04-06 carry the statutory baseline to 2026-04-07. | Tuesday, April 7, 2026 |
| Final holiday or unsupported Saturday | Exclude sent day 2026-07-02. Enumerate 90 consecutive days through 2026-09-30, including every winter holiday. Final holidays 2026-09-30 carry the statutory baseline to 2026-10-01. | Thursday, October 1, 2026 |
| Established statutory trigger | Counting the General Procedure recess would apply the wrong procedural clock. Exclude sent day 2026-12-15. Enumerate 90 consecutive days through 2027-03-15, including every winter holiday. No final named federal holiday adjustment is required. | Monday, March 15, 2027 |
| Established statutory trigger | Receipt on June 8 is not substituted for dispatch on June 2. Exclude sent day 2026-06-02. Enumerate 90 consecutive days through 2026-08-31, including every winter holiday. No final named federal holiday adjustment is required. | Monday, August 31, 2026 |
| Final holiday or unsupported Saturday | Exclude sent day 2026-07-05. Enumerate 90 consecutive days through 2026-10-03, including every winter holiday. That endpoint is a Saturday. The baseline and current Court guidance have not been reconciled, so the application must withhold a computed and purchasable date. | No calculated or purchasable date. Saturday endpoint requires review. |
| Final holiday or unsupported Saturday | Exclude sent day 2026-01-03. Enumerate 90 consecutive days through 2026-04-03, including every winter holiday. Final holidays 2026-04-03 carry the statutory baseline to 2026-04-04. That endpoint is a Saturday. The baseline and current Court guidance have not been reconciled, so the application must withhold a computed and purchasable date. | No calculated or purchasable date. Saturday endpoint requires review. |
Fictitious independently established statutory events in 2026 and 2027. Examples use the named federal holiday baseline and assume no additional qualifying local holiday. Refusal examples are not verified legal deadlines. These examples do not establish notice dispatch, the original expiry, relief conditions, filing acceptance or a court order.
Try these dates in the calculatorWhich objection and appeal qualifications must I check?
- Objection first
- Section 169(1) concerns a taxpayer who has served a section 165 objection. The calculator does not establish a valid objection or turn an original assessment into a confirmation.
- Unanswered objection
- After 90 days from service of an objection, section 169(1)(b) can permit an appeal without a disposition notice. Establish all its conditions separately. Do not use this calculator to invent a final deadline for that gateway.
- Restricted grounds and waived issues
- Sections 169(2), (2.1) and (2.2) can restrict grounds, large-corporation issues and relief, or bar issues waived in writing. A displayed date does not establish an available appeal issue.
- Late appeal
- Section 167 requires a separate application if the section 169 period was missed. The one-year outer application window does not automatically revive the appeal.
- Statutory clock and Saturday limit
- The Court excludes statutory notices of appeal from the winter-recess pause. Its broad Saturday-extension guidance differs from the statutory holiday baseline. This calculator withholds a Saturday result until that question is resolved.
- Procedure and accepted filing
- General Procedure section 21 and Informal Procedure section 4 specify how an appeal begins. Check the chosen procedure, contents, copy requirements and any fee. Registry receipt, not dispatch alone, must be established.
- The calculator covers established event and final dates in 2026 and 2027 using the named federal holiday baseline.
- The sent date and receipt date can differ materially. The winter-recess comparison also changes the result if the wrong procedural clock is used. Saturday endpoints are withheld instead of presenting an unresolved expiry as a verified result.

Questions about income-tax appeal timing
When must I appeal an income-tax confirmation or reassessment to the Tax Court of Canada?
Does the clock start when I receive or open the notice?
The section 169(1) closing period runs from the day the qualifying notice was sent. Establish that date. A later receipt or opening does not automatically restart 90 days.
Income Tax Act section 169(1)Can I appeal before CRA decides my objection?
Section 169(1)(b) provides an alternative gateway after 90 days have elapsed following service of the objection, if the Minister has not notified the taxpayer of the stated disposition. Establish those facts separately.
Income Tax Act section 169(1)Does the court winter holiday add 18 days?
No. The Court expressly distinguishes statutory appeal deadlines from General Procedure periods. Count December 21 through January 7 in the 90 days.
Tax Court guidance on filing dates, winter holidays and local closuresWhat if the ninetieth day is a Sunday or federal holiday?
Interpretation Act section 26 permits the act on the next day that is not a holiday. Check section 35(1), the applicable local holidays and any additional proclamation before relying on the baseline date.
Interpretation Act sections 26, 27, 28, 35(1) and 37Why does a Saturday endpoint produce no result?
The Court guidance describes a Saturday extension, while the reviewed statutory holiday provision does not itself classify an ordinary Saturday as a holiday. This calculator withholds that unresolved result and its purchase. Establish the applicable filing position separately.
Tax Court guidance on filing dates, winter holidays and local closuresIs mailing the notice on the last day enough?
Do not assume that posting establishes filing. The Court guidance requires Registry receipt within the appeal period. In Informal Procedure, section 4.2 identifies the received stamp or electronic acknowledgment as the filing date.
Informal Procedure sections 4 and 4.2Does a timely date mean every assessment issue can be appealed?
No. Section 169 contains restrictions for particular reassessments, large-corporation issues and relief, and issues waived in writing. The calculator does not decide the grounds or jurisdiction.
Income Tax Act sections 169(2) to (2.2)What if I miss the 90 days?
Check a section 167 application immediately. It has a one-year outer window measured from the original appeal expiry and requires proof of every condition. Waiting until that outer date can fail the requirement to apply as soon as circumstances permitted.
