When must an eligible Court of Appeal review be requested?

CPR 52.24(7) requires an eligible officer-decision review or single-judge paper reconsideration request within 7 days after the party is served with notice of the decision. Certain single-judge decisions are excluded.

Responsible actor. Party requesting review.

This seven-day Court of Appeal internal review follows service of notice. It does not create an oral renewal right for a permission refusal.

Rule 52.24(7) uses service on the party of notice of the eligible decision.

Officer decisions use paragraph 5. Single-judge paper decisions use paragraph 6, which excludes an officer-review decision and a decision determining permission to appeal.

CPR 52.24(5)–(7)

How does this provision count time?

  1. CPR 52.24(7) requires an eligible officer-decision review or single-judge paper reconsideration request within 7 days after the party is served with notice of the decision. Certain single-judge decisions are excluded.
  2. Paragraph 5 provides review by a single judge, ordinarily on paper.
  3. File the request within the established service-based period. Identify the decision-maker and eligible review branch before using the date.

For CPR 52.24(5)–(7), exclude the established starting day and count the next 7 calendar days. CPR 2.8(3)(b) does not exclude an additional fixed compliance day. This is the ordinary fixed-after branch, not a minimum interval between two specified events.

The CPR 52.24(5)–(7) court-office filing act can use CPR 2.8(5) when its fixed endpoint is closed. Check the actual office, any exceptional closure and the order. This does not extend a separate service act.
