CPR 89.7(3)–(6), (9)–(12)How does this provision count time?
- Exclude the order-service day and include the fourteenth calendar day. Do not add an extra day simply because CPR 2.8 calls the period clear days.
- For the application at the court office, apply CPR 2.8(5) only with the actual closed final day and next opening established. The on-notice requirement needs its own completion and service analysis.

Questions about this procedure
When may a party apply to reconsider an attachment of earnings order?
Does making the attachment order start the fourteen-day reconsideration clock?
The stated event is service of the order. Establish effective service on the applicant instead of substituting the date the order was made.
CPR 89.7(3), (9)May an employer use this creditor-or-debtor reconsideration provision?
Paragraphs (3) and (9) identify the creditor or debtor. An employer’s different statutory or procedural application must be considered on its own source.
CPR 89.7(3), (9)Must the reconsideration application include reasons?
Yes. Both paragraphs require reasons and an application on notice within the stated period. A bare expression of dissatisfaction does not establish those requirements.
CPR 89.7(3), (9)Does every District Judge attachment order use paragraph (9)?
Paragraph (9) concerns an order made under paragraph (7)(a), the without-hearing branch. Identify the actual order route before using this period.
CPR 89.7(7)(a), (9)Is fourteen days also the required notice of the reconsideration hearing?
No. The hearing notice under paragraphs (5) and (11) is not less than two days. The application and hearing-notice clocks concern different acts.
CPR 89.7(3)–(5), (9)–(11)Must a timely reconsideration application succeed?
No. On hearing the application, the District Judge may confirm the order or set it aside and make a new order as appropriate.
