The raw two-year anniversary excludes the inclusive acceptance day and cannot establish the repeal/saving branch. It also cannot decide the present homelessness and statutory exclusions.

When does the saved two-year private-offer reapplication route apply?
Section 195A uses two years beginning with acceptance of the qualifying private rented sector offer. The May 2026 repeal requires the tenancy commencement and SI 2026/421 regulation 10 saving to be checked, including offers accepted before May 1.
Responsible actor. The authority considering a qualifying saved reapplication after a private rented sector offer.
Establish the earlier qualifying offer and acceptance.
Section 195A concerns revived housing-duty conditions after reapplication. Section 198(2ZA) separately addresses local-connection referral and domestic-abuse risk.
The saved route requires reapplication, homelessness, eligibility and no satisfaction of intentional homelessness. Restricted-person and immediately preceding section 195A application exclusions remain material.
Housing Act 1996, section 195AHow does this provision count time?
- Establish the earlier qualifying offer and acceptance.
- Apply the actual May 2026 repeal and regulation 10 saving.
- Check reapplication timing and all remaining statutory conditions.
Include the qualifying acceptance date in the two-calendar-year period. A saved October 8, 2025 acceptance ordinarily ends October 7, 2027, not its following anniversary.
The reapplication eligibility window is not a court-office filing period. Do not extend the saved two-year condition merely because its last day is a weekend.
Housing Act 1996, section 195AWhich facts prevent one automatic date?
The raw two-year anniversary excludes the inclusive acceptance day and cannot establish the repeal/saving branch. It also cannot decide the present homelessness and statutory exclusions.
Acceptance of a qualifying section 193(7AA) offer before the relevant repeal, with saving established is established as 2025-10-08. Include the qualifying acceptance date in the two-calendar-year period. A saved October 8, 2025 acceptance ordinarily ends October 7, 2027, not its following anniversary. On the expressly established branch, the conditional period endpoint is 2027-10-07. Present the earlier accepted offer, saving and current reapplication evidence to the authority. A date calculation does not establish the substantive reapplication conditions.
Acceptance of a qualifying section 193(7AA) offer before the relevant repeal, with saving established is established as 2025-10-10; distinguish authority and court obligations. The reapplication eligibility window is not a court-office filing period. Do not extend the saved two-year condition merely because its last day is a weekend. The conditional statutory or ordinary threshold is 2027-10-09. This guide supplies no automatic carry. Any court-office or effective-service adjustment requires its exact legal conditions.
The earlier qualifying offer was accepted April 20, 2026. Regulation 10 expressly saves section 195A against the repeal for qualifying pre-May acceptance. Establish that saving and other conditions; do not assume the May 1 repeal eliminates every running two-year branch.

Questions about this procedure
When does the saved two-year private-offer reapplication route apply?
Are pre-May 2026 accepted offers expressly saved?
SI 2026/421 regulation 10 provides that the section 195A repeal does not apply where the qualifying offer was accepted before May 1, 2026.
SI 2026/421, regulations 2 and 10Is priority need required by the saved section 195A route?
Section 195A(1) applies the main duty regardless of priority need when its other stated conditions are met.
Housing Act 1996, section 195ADoes a two-year anniversary alone prove a qualifying reapplication?
No. Homelessness, eligibility, intentionality, the applicable saving and the statutory exclusions must be established.
Housing Act 1996, section 195ACan successive section 195A reapplications automatically repeat the route?
Section 195A(6) excludes a reapplication whose immediately preceding application was itself one to which subsection (1) applied.
Housing Act 1996, section 195ADoes section 195A count the acceptance day?
Yes. Its period begins with the acceptance date. A two-year anniversary-only model omits that inclusive boundary.
Housing Act 1996, section 195ACan this reapplication provision be treated as a deadline for court proceedings?
No. It defines a housing-duty route following reapplication to an authority, not the time for a section 204 appeal.
