How long must I wait after refusal to remove a driving disqualification?

Section 42(4) prevents a further removal application from being entertained if made within three months after refusal. This is a restriction on a new application, not a deadline to apply. The separate initial eligibility rules, excluded suspended time and any extension period must still be checked.

How does this provision count time?

  1. Establish the full statutory restricted interval before choosing a fresh application date. This source guide does not convert the anniversary into an automatic eligible filing day.
  2. The restricted interval must elapse before an otherwise eligible fresh application. Establish the court’s accepted method and the exact statutory boundary rather than guessing from a closed anniversary date.

The court refused an earlier section 42 removal application. A further application cannot be entertained within three months after refusal. Establish the restricted interval and independent initial eligibility.

Three months have elapsed, but the original section 42(3) eligibility period has not. The repeat-application restriction does not replace initial eligibility. Do not treat elapsed three months alone as permission to apply.

The order disqualifies the driver until passing a test under section 36(1). Section 42(6) excludes that category from the preceding provisions. Use the appropriate test-related route rather than section 42 removal.
