When does the fixed 22-day limb of an interim supervision order end?

Section 86(3)(d) or (e) supplies a fixed 22-day limb beginning on actual making or the latest valid sheriff extension. The event day is day one. Responsible actor. Person establishing the actual statutory period.

Establish actual making of the unextended order or the latest actual qualifying sheriff extension.

The instrument is an actual interim compulsory supervision order within section 86. A medical examination order, interim variation or another order uses a different source.

This calculates only the fixed 22-day limb in section 86(3)(d) or (e). The actual relevant period ends at the first listed event. A next hearing, sheriff disposal or specified day can end it earlier. A later lawful extension requires a new calculation.

Which conditions and exceptions apply?

Source condition 1
The instrument is an actual interim compulsory supervision order within section 86. A medical examination order, interim variation or another order uses a different source.
Source condition 2
I need the fixed 22-day limb only. This calculation does not determine the earliest section 86(3) ending, actual continuing effect of the order or whether a later extension will be granted.
Source condition 3
For an unextended order, the actual making date applies. For an extension, the sheriff actually granted the applicable section 98 or 99 extension before the prior order expired. A request, scheduled hearing or assumed extension is not enough.
Source condition 4
The selected event is the current operative making or latest qualifying extension. An older order or earlier extension is not substituted.
Source condition 5
The ordinary current 22-day limb applies. No historical temporary modification or different statutory regime changes this limb. The making or extension day counts as day one.
Source condition 6
The next children’s hearing, qualifying sheriff disposal and any day specified in the order must be checked separately under section 86(3)(a)-(c). They are not inferred or displaced by this outer-limit date.
Children’s Hearings (Scotland) Act 2011 s 86(3)(d),(e), ss 98,99
  • This calculates only the fixed 22-day limb in section 86(3)(d) or (e). The actual relevant period ends at the first listed event. A next hearing, sheriff disposal or specified day can end it earlier. A later lawful extension requires a new calculation.
  • The actual source event and statutory limb control. Another hearing, later correspondence or a different procedural step does not automatically start the same clock.

Can the order end before the calculated date?

Yes. Section 86(3) uses whichever listed ending occurs first. Check the next hearing, qualifying sheriff disposal and any day specified in the actual order. A request or scheduled extension hearing does not establish a valid extension.
