When must a party demand a jury trial under Rule 38?

For an issue triable of right by jury, Rule 38(b) ordinarily requires serving a written demand no later than fourteen days after the last pleading directed to that issue is served, and filing the demand under Rule 5(d). The relevant issue, pleading and incoming service must be established.

Responsible actor. The party demanding trial by jury on an issue triable of right by jury.

Identify the particular issue and whether it is triable of right by jury. The rules do not create a jury right for every claim.

Read the pleadings directed to that issue and establish which is the last. Do not choose the first document simply because it arrived first.

Rule 7(a) distinguishes pleadings from motions. A Rule 12 motion is not a pleading merely because it addresses the case.

Preserve effective service of the actual last issue pleading and identify any separate Rule 38(c) demand on additional issues.

How does this provision count time?

  1. Identify the selected procedural act and responsible party.
  2. Establish every required qualifying document, operative event and actual service method.
  3. Apply only the supported period, sequential service addition and any required earlier-or-later comparison.
  4. Check actual orders, stipulations, local conditions and completion of the required service or filing.

FRCP 6(a) excludes the operative event day, counts intermediate calendar days and continues a final Saturday, Sunday or legal holiday to the next qualifying day. When Rule 6(d) applies, its three days follow the period’s ordinary Rule 6(a) expiration. Electronic service receives no Rule 6(d) addition. Establish the authorized service method rather than adding three days to every service-based period.

FRCP 6(a)(6) includes the listed federal holidays, declared presidential or congressional holidays and, for forward periods, holidays declared by the state where the district court sits. Actual clerk inaccessibility has separate Rule 6(a)(3) treatment for filing. Check the named court, actual orders and additional state holidays. A national calendar alone cannot establish them.

Which facts prevent one automatic date?

This source guide requires an established jury-triable issue, last relevant pleading and effective service method. It publishes no automatic date or paid calculation. A date-only input cannot establish those facts or completed demand service and filing.

ResultRead the operative provision and establish the applicable branch.

Assume a jury-triable issue and the established last pleading directed to that issue electronically served October 6, 2026. Fourteen days after the established service event is October 20. Rule 38(b) requires serving the written demand and filing under Rule 5(d). The example establishes neither a jury right nor completed service and filing. This guide publishes no computed date.

Assume that established last pleading served by qualifying mail October 6, 2026. The ordinary fourteen-day expiration is October 20. Rule 6(d) then adds three days, giving October 23 under the stated facts. Preserve the actual incoming service method. The fourteen-day number alone does not establish this branch.

Assume a complaint served October 6 and a later answer directed to the same jury issue electronically served October 20. Rule 38(b) uses the last pleading directed to the issue. With that assumption, the October 20 answer supplies the event and the fourteen-day illustration reaches November 3. Do not select the first pleading mechanically. A motion is not a pleading under Rule 7(a).

Assume the established last issue pleading effectively served electronically July 4, 2026. Fourteen days reaches Saturday, July 18. Rule 6(a) continues the ordinary endpoint to Monday, July 20 under the stated holiday facts. Both serving and filing the demand remain necessary. The source guide does not certify either act.

Which conditions and exceptions apply?

Issue-specific last pleading
Rule 38(b) identifies the last pleading directed to the issue. Establish that relationship from the actual pleadings, rather than using any docket document.
Pleading differs from motion
Rule 7(a) enumerates pleadings. Motions under Rule 7(b) do not automatically become the last pleading for Rule 38(b).
Additional issues
Where a demand specifies only some issues, Rule 38(c) supplies a separate demand route for other jury-triable factual issues within fourteen days after demand service or a shorter court-ordered time.
Waiver and possible later relief
Rule 38(d) addresses waiver absent proper service and filing. Rule 39(b) provides a discretionary court-ordered jury route; it is not an automatic extension.

  • An ordinary Rule 38(b) demand, a Rule 38(c) additional-issue demand and a post-removal jury demand have different operative events. A discretionary Rule 39(b) request is a separate procedure.

What must the responsible actor complete?

Questions about this procedure

When must a party demand a jury trial under Rule 38?

Does the complaint always start the jury-demand period?

No. Rule 38(b) uses the last pleading directed to the particular issue. A later answer or another qualifying pleading can supply that event. Establish the actual issue and pleadings.

FRCP 38(b)–(e), printed p. 65, December 1, 2025

Does a Rule 12 motion count as the last pleading?

Not merely because it was filed. Rule 7(a) lists pleadings and distinguishes them from motions. Identify the actual last pleading directed to the jury issue.

FRCP 7(a), printed p. 14, December 1, 2025

Is serving the written demand enough?

No. Rule 38(b) also requires filing in accordance with Rule 5(d), and Rule 38(d) ties waiver to proper service and filing.

FRCP 38(b)–(e), printed p. 65, December 1, 2025

Can I demand a jury on additional issues after another party limits its demand?

Rule 38(c) supplies a separate route for other or all jury-triable factual issues. It ordinarily uses fourteen days after service of the limited demand, subject to a shorter ordered period.

FRCP 38(b)–(e), printed p. 65, December 1, 2025

Does the service method of the last pleading affect the ordinary period?

Yes where Rule 6(d) applies. Qualifying mail receives three days after ordinary expiration. Electronic service receives no automatic Rule 6(d) addition.

FRCP 6(a), (b), (d), printed pp. 12–14, December 1, 2025

Does missing Rule 38 time make a later jury trial automatic or impossible?

Neither conclusion follows automatically. Rule 38(d) addresses waiver, while Rule 39(b) permits the court, on motion, to order a jury trial on eligible issues. Actual relief requires separate review.
