Which Florida foreclosure accrual and mortgage-lien periods need comparison?

Section 95.11(2)(c) places mortgage foreclosure in the five-year category. Section 95.031 ordinarily uses legal accrual. Recorded mortgage-lien termination under section 95.281 and a qualifying residential deficiency action use different events and periods. This guide preserves those distinctions and computes no complete foreclosure deadline.

Establish the complete Florida limitation or repose procedure

A single default-date preset cannot establish legal accrual across installment, acceleration, prior-action and maturity history. Mortgage-lien termination and deficiency claims are separate. No computed or paid foreclosure date is released.

Which actual event starts this Florida limitation or repose period?

Preserve the actual note, mortgage, payments, alleged defaults, acceleration and prior-action records.

Determine the legally applicable foreclosure accrual event instead of assuming mortgage execution or every notice supplies it.

Compare recorded lien maturity and extension records separately from any qualifying deficiency action.

2026 Florida Statutes section 95.11(2)(c)

How does Florida treat this limitation or repose?

  1. Preserve the actual note, mortgage, payments, alleged defaults, acceleration and prior-action records.
  2. Establish each statutory clock, actual event, discovery and applicable exceptions. Compare the competing endpoints. This guide computes no date.
  3. Preserve each trigger, legally available tolling interval, applicable clerk calendar and actual filing receipt.
  4. Complete the required act with the proper court or recipient.

A period stated in years requires its corresponding calendar endpoint under the governing authority. A repose boundary can differ from a discovery-based limitation. Establish the applicable final-day rule, actual clerk calendar and any permitted tolling or extension. Rule 2.514 does not itself prove that a statutory repose has been extended. These conditional guides issue no calendar date.

Why does this procedure need a separate comparison?

A single default-date preset cannot establish legal accrual across installment, acceleration, prior-action and maturity history. Mortgage-lien termination and deficiency claims are separate. No computed or paid foreclosure date is released.

Which Florida limitation or repose qualifications change the procedure?

Foreclosure uses its own five-year statutory category
Section 95.11(2)(c) states the foreclosure category. Section 95.031(1) ordinarily uses the last element of the cause. Actual installment, acceleration and prior-action facts require their governing legal treatment. This guide does not choose a single accrual event or characterize every later installment as automatically enforceable.
Recorded lien termination is a separate statute
Section 95.281(1) ordinarily uses five years after ascertainable recorded final maturity, or its twenty-year mortgage-date branch when maturity is not ascertainable, with prescribed recording alternatives. Recorded extension agreements and installment maturity have stated treatment. This lien-termination analysis is not the foreclosure action’s generic five-year accrual clock.
Ordinary limitation tolling does not automatically extend this lien
Section 95.051 expressly excepts section 95.281. Section 95.281(4) limits extension to its prescribed methods. Do not add negotiation, part payment, nonresidence or disability to the recorded-lien period without the applicable statutory foundation. Preserve actual recording history and qualifying mortgage status.
A qualifying residential deficiency action has its own event
Section 95.11(6)(g) addresses the stated deficiency claim involving a note secured by a one-family to four-family residential dwelling. Its one-year period starts the day after the clerk’s certificate or acceptance of a deed in lieu. Establish actual claim coverage and event separately from foreclosure commencement.
Tolling requires an actual statutory ground
Section 95.051 limits limitation tolling to its stated grounds and referenced laws. Absence, false name and concealment do not toll when sufficient jurisdictional service remains available. Incapacity and minority carry specific conditions and outer limits. Negotiation or a demand letter alone does not establish tolling. Repose requires its own governing treatment.
An out-of-state cause can already be barred
Section 95.10 prevents maintaining an action in Florida when the cause arose elsewhere and that jurisdiction bars it through lapse of time. Establish where the actual cause arose and its governing law. A Florida period does not automatically revive the foreign-barred cause.

  • This guide does not decide legal accrual, due diligence, a statutory exception, an expired claim, valid filing or successful enforcement.
  • Check the governing historical edition, actual motions, orders, clerk holidays and filing receipts.
