When must notice of an FAA award challenge be served?
Under 9 U.S.C. 12, the challenging party ordinarily must serve notice of a motion to vacate, modify or correct an award within three months after the award is filed or delivered. Filing the motion alone does not establish timely service.
- Period
- Three calendar months for the ordinary section 12 notice-service branch
- Trigger
- The established date the award is filed or delivered
- Rule
- 9 U.S.C. 12 [2024 Edition, laws through January 6, 2025]
Retained statutory baseline is the authenticated 2024 United States Code, laws in effect January 6, 2025. October 8, 2026 OLRC requests returned maintenance pages; a 2025 GovInfo request did not acquire the requested statute. No current consolidated statute is claimed. The official September 28, 2026 NRCO order corroborates the ordinary three-month notice-service rule and weekend endpoint. The retained December 1, 2025 FRCP compilation and official 2016 and 2023 circuit opinions support the identified counting and equitable-relief qualifications. This is a scoped ordinary model, not an exhaustive subsequent-law or exception audit.

When must notice of an FAA award challenge be served?
Under 9 U.S.C. 12, the challenging party ordinarily must serve notice of a motion to vacate, modify or correct an award within three months after the award is filed or delivered. Filing the motion alone does not establish timely service.
Responsible actor. The party seeking to vacate, modify or correct the arbitration award.
Identify the award whose vacatur, modification or correction is sought. Preserve the award and evidence establishing when it was filed or delivered.
Do not replace the award event with the date counsel learned a possible challenge ground or filed the motion. Establish which statutory event controls the actual facts.
A reconsideration request, corrected award, foreign award or competing state-law route requires separate analysis. This ordinary model does not establish whether those facts change the operative event.
Use the ordinary federal section 12 clock after establishing the operative award event, competent court and applicable service procedure. This calculation does not decide award finality, effective service, jurisdiction or entitlement to equitable relief.
9 U.S.C. 12 [2024 Edition, laws through January 6, 2025]How does this provision count time?
- Establish the ordinary federal section 12 branch and operative award event.
- Advance three calendar months to the corresponding calendar date. Do not substitute ninety days.
- Check applicable last-day weekend and legal-holiday treatment, actual directions and court-specific facts.
- Complete legally effective notice service by the applicable endpoint. Preserve evidence of service separately from filing.
Section 12 states months. NuVasive, page 28 footnote 9, expressly rejects ninety-day substitution. The ordinary corresponding-date calculation uses applicable FRCP 6 last-day treatment. Rule 81(a)(6)(B) applies the Civil Rules to Title 9 proceedings to the extent applicable unless the statute provides another procedure.
Under applicable FRCP 6(a), a final Saturday, Sunday or legal holiday continues to the next qualifying day. Forward counting includes applicable state holidays where the district court sits. The NRCO order reports May 1, 2026 delivery and an August 3 endpoint after Saturday, August 1. Check actual court-specific facts; a national holiday list cannot establish every closure.
9 U.S.C. 12 [2024 Edition, laws through January 6, 2025]What do independently checked examples show?
Fictitious example
The established award filing or delivery event is July 6, 2026. The corresponding October date is an ordinary Tuesday. Fictitious established ordinary federal district-court facts. The operative award date and applicable section 12 route are established. No additional state holiday, actual order, access problem or granted relief changes the stated result. Required service remains separate from calculation.
| Step | What is counted | Date |
|---|---|---|
| Example 1. Ordinary established facts | The established award filing or delivery event is July 6, 2026. The corresponding October date is an ordinary Tuesday. Fictitious established ordinary federal district-court facts. The operative award date and applicable section 12 route are established. No additional state holiday, actual order, access problem or granted relief changes the stated result. Required service remains separate from calculation. Three calendar months after Monday, July 6, 2026 gives Tuesday, October 6, 2026. No last-day adjustment applies under these facts. | Tuesday, October 6, 2026 |
| Example 2. Closed-day boundary | The established award delivery event is May 1, 2026. The corresponding August date falls on Saturday. The official September 28, 2026 NRCO order reports the same ordinary August 3 endpoint. Fictitious established ordinary federal district-court facts. The operative award date and applicable section 12 route are established. No additional state holiday, actual order, access problem or granted relief changes the stated result. Required service remains separate from calculation. Three calendar months after Friday, May 1, 2026 gives Saturday, August 1, 2026. The expressly identified final-day sequence continues to Monday, August 3, 2026. | Monday, August 3, 2026 |
| Example 3. Material procedural branch | The established award filing or delivery event is March 4, 2026. This is a three-month period, not a ninety-day period. Fictitious established ordinary federal district-court facts. The operative award date and applicable section 12 route are established. No additional state holiday, actual order, access problem or granted relief changes the stated result. Required service remains separate from calculation. Three calendar months after Wednesday, March 4, 2026 gives Thursday, June 4, 2026. No last-day adjustment applies under these facts. Ninety days would instead end June 2. NuVasive footnote 9 rejects that substitution for an award dated March 4. | Thursday, June 4, 2026 |
| Example 4. Closed-day boundary | The established award event is September 25, 2026. The corresponding December date is Christmas Day, followed by Saturday and Sunday. Fictitious established ordinary federal district-court facts. The operative award date and applicable section 12 route are established. No additional state holiday, actual order, access problem or granted relief changes the stated result. Required service remains separate from calculation. Three calendar months after Friday, September 25, 2026 gives Friday, December 25, 2026. The expressly identified final-day sequence continues to Monday, December 28, 2026. | Monday, December 28, 2026 |
Fictitious established facts. These examples do not establish eligibility, effective service, relief or a direction.
Try these dates in the calculatorWhich conditions and exceptions apply?
- Equitable tolling is circuit-specific
- Move and NuVasive recognize equitable tolling in appropriate circumstances. Actual granted relief and the controlling circuit require separate review. An allegation of fraud or diligence does not automatically change the displayed ordinary date.
- Service differs from filing
- Section 12 prescribes notice service and distinguishes resident and nonresident recipients. Establish the applicable service route rather than assuming filing alone suffices.
- Other remedies and proceedings
- This is not a deadline to confirm an award or to challenge a later court judgment. Foreign-award defenses, state statutes and judgment remedies can raise different rules.
- Unsupported operative events
- A disputed award delivery, reconsideration, correction or award finality requires separate source and factual review. The ordinary input must represent the established operative event.
- Use the ordinary federal section 12 clock after establishing the operative award event, competent court and applicable service procedure. This calculation does not decide award finality, effective service, jurisdiction or entitlement to equitable relief.
- An award challenge under section 12 differs from a motion challenging a court judgment and a notice of appeal. The linked procedures have different operative events and required acts.

Questions about this procedure
When must notice of an FAA award challenge be served?
Is the FAA section 12 period ninety days?
No. It is three months. NuVasive footnote 9 explains that a March 4 award ordinarily gives June 4, rather than the June 2 result from ninety days.
NuVasive, Inc. v. Absolute Medical, LLC, No. 22-10214 (11th Cir. June 21, 2023), pp. 17–29 and p. 28 n.9Does filing my motion within three months establish compliance?
Not by itself. Section 12 requires notice to be served on the adverse party or attorney. Preserve separate evidence of legally effective service.
9 U.S.C. 12 [2024 Edition, laws through January 6, 2025]Does motion service start the three-month clock?
No. The statute starts from the established award filing or delivery event. Notice service is the act to complete within that period.
9 U.S.C. 12 [2024 Edition, laws through January 6, 2025]Can equitable tolling ever apply to section 12?
Yes in appropriate circumstances under the cited Ninth and Eleventh Circuit decisions. Controlling circuit law and actual relief matter. The calculator includes no automatic equitable extension.
Move, Inc. v. Citigroup Global Markets, Inc., No. 14-56650 (9th Cir. November 4, 2016), pp. 8–11What happens when the ordinary corresponding date is Saturday?
Check applicable Rule 6 last-day treatment. The official NRCO order reports May 1, 2026 award delivery with an August 3 endpoint after Saturday, August 1. Additional local facts still require review.
NRCO Engineering, S.A. v. Linden Energy, LLC, No. 4:26-cv-03617, Document 17 (S.D. Tex. September 28, 2026), p. 6Do I automatically add three days because someone mailed the award?
No automatic Rule 6(d) addition is included. That rule concerns specified periods after service of a paper; section 12 uses the award’s filed-or-delivered event. Establish the actual governing service and award facts.
