When may an early Rule 34 request be delivered?
Rule 26(d)(2)(A) allows the stated early Rule 34 delivery more than twenty-one days after summons and complaint service on a party. Day twenty-one is not itself more than twenty-one days. Subsection (B) considers the request served at the first Rule 26(f) conference. Delivery and deemed service are different events. This guide computes no date.

Which event starts this procedure?
Establish summons and complaint service on the relevant party.
Check whether delivery is to that party by another party or by that party to a plaintiff or another served party.
Preserve the first Rule 26(f) conference date. Subsection (B) uses it as the deemed service event.
FRCP 26(d)(2)Which timing conditions must be established?
- Identify the actual actor, pleading and required act.
- Establish the specified event and applicable order.
- Resolve the material conditions. This guide publishes no calculated date.
- Check final-day conditions and preserve service and filing evidence separately.
Apply the strict more-than wording to the actual service event. Do not turn day twenty-one into an earliest-permitted date. Delivery eligibility and the later conference service event must remain separate.
Rule 6(a) excludes the operative event and counts intermediate calendar days. A final Saturday, Sunday or legal holiday moves forward. Rule 6(a)(6) includes federal and President or Congress declared holidays, plus state-declared holidays for forward periods in the district. Qualifying clerk inaccessibility matters separately for filing.
FRCP 6(a)(1)Why is no automated date published?
The encoded twenty-one-day expiry does not implement the strict more-than threshold or the later deemed-service event. The guide publishes no calculated delivery or response date.
Which conditions change the assessment?
- More than twenty-one days
- Rule 26(d)(2)(A) uses more than twenty-one days. A day-twenty-one result is not the stated first permissible day.
- Specified delivery branches
- Delivery may be to the served party by another party, or by the served party to a plaintiff or another party already served.
- Deemed service later
- The early request is considered served at the first Rule 26(f) conference under subsection (B), rather than automatically on delivery.
- This page does not establish effective service, merits, compliance or an actual court grant.
- Service and filing are different acts. Verify both when required.
