What does the ordinary thirty-day judgment enforcement stay cover?
Except as Rules 62(c) and (d) provide, execution and proceedings to enforce a judgment are stayed for thirty days after entry unless the court orders otherwise. The stay is not a notice-of-appeal deadline. Injunction, receivership and patent-accounting orders have separate treatment. Establish the judgment and actual order. This guide computes no enforcement date.

Which event starts this procedure?
Preserve the actual judgment and establish entry under the applicable Rule 58 branch.
Identify whether the judgment concerns injunction, receivership or patent accounting.
Read actual stay orders and any court-approved bond or other security rather than assuming ordinary expiry permits enforcement.
FRCP 62(a)Which timing conditions must be established?
- Identify the actual actor, pleading and required act.
- Establish the specified event and applicable order.
- Resolve the material conditions. This guide publishes no calculated date.
- Check final-day conditions and preserve service and filing evidence separately.
Establish judgment entry under Rule 58 and the actual judgment type. Apply Rule 6(a) only after identifying the operative stay and actual order. A nominal thirty-day value does not by itself authorize execution.
Rule 6(a) excludes the operative event and counts intermediate calendar days. A final Saturday, Sunday or legal holiday moves forward. Rule 6(a)(6) includes federal and President or Congress declared holidays, plus state-declared holidays for forward periods in the district. Qualifying clerk inaccessibility matters separately for filing.
FRCP 6(a)(1)Why is no automated date published?
Judgment type, court orders, actual entry and other stay authority are material. The single-date preset does not determine when enforcement may lawfully proceed.
Which conditions change the assessment?
- Excluded judgment types
- Rule 62(c), unless the court orders otherwise, does not stay the specified injunction, receivership or patent-accounting judgments after entry, even if appealed.
- Security approval
- Rule 62(b) permits a stay by bond or other security. It takes effect when the court approves the security and lasts for the specified time.
- Separate appellate and other stays
- Rule 62(d), (f)–(h) preserves the stated injunction, state-law, appellate and multiple-claim stay procedures. The automatic stay does not establish every available stay.
- This page does not establish effective service, merits, compliance or an actual court grant.
- Service and filing are different acts. Verify both when required.
