When must a party comply with an order for a more definite statement?
Rule 12(e) allows the court to strike the pleading or issue another appropriate order if its statement order is not obeyed within fourteen days after notice, or within the time the court sets. Read the actual required compliance and court time. Noncompliance does not automatically dismiss the action. This guide calculates no date.

Which event starts this procedure?
Read the actual order requiring a more definite statement, its required detail and any time the court sets.
Establish actual notice. Entry or receipt assumptions do not by themselves determine the applicable notice event.
Keep providing the statement separate from the other party’s response after service under Rule 12(a)(4)(B).
FRCP 12(e)Which timing conditions must be established?
- Identify the actual actor, pleading and required act.
- Establish the specified event and applicable order.
- Resolve the material conditions. This guide publishes no calculated date.
- Check final-day conditions and preserve service and filing evidence separately.
Establish the actual notice event and applicable court-set time before applying Rule 6(a). This guide does not determine compliance or select the controlling order time.
Rule 6(a)(1) excludes the event day and counts intermediate calendar days. A final Saturday, Sunday or legal holiday carries the period forward to the next qualifying day. Rule 6(a)(6) includes federal and President or Congress declared holidays, plus state-declared holidays for forward periods in the district. Qualifying clerk inaccessibility is a separate filing condition.
FRCP 6(a)(1)Why is no automated date published?
The actual order can set a different time and defines the required compliance. This single-date preset does not establish those facts or publish a calculated date.
Which conditions change the assessment?
- Court-set compliance
- Rule 12(e) expressly refers to fourteen days after notice or the time the court sets. Read the operative order.
- Discretionary consequence
- The court may strike the pleading or issue another appropriate order. The text does not impose automatic dismissal for every missed statement deadline.
- Different responsive act
- The opponent’s response under Rule 12(a)(4)(B) starts after service of the resulting statement. That is a separate question.
- Actual court enlargement
- Rule 6(b)(1) permits actual court enlargement for good cause. Before expiry, the court may act with or without motion or notice, or a request may be made. After expiry, a motion requires failure to act because of excusable neglect. A request or agreement is not a granted extension.
- This page does not establish effective service, merits, compliance or an actual court grant.
- Service and filing are different acts. Verify both when required.

Common questions
This procedure and its conditions
Does a missed date automatically dismiss the case?
No. Rule 12(e) permits the court to strike the pleading or issue another appropriate order. Establish the actual court action separately.
FRCP 12(e)Can the order specify a different time?
Yes. Rule 12(e) expressly includes the time the court sets. Read the actual order before assessing compliance.
FRCP 12(e)Does the same event start the opponent’s answer period?
No. Rule 12(a)(4)(B) uses service of the more definite statement after the actual grant, rather than notice of the order to provide it.
