When must an unanswered defendant respond after removal?
A defendant who did not answer before removal must answer or present other defenses or objections within the longest of three periods. They are twenty-one days after initial-pleading receipt through service or otherwise, twenty-one days after summons service for an initial pleading on file, or seven days after removal notice is filed. This guide calculates no date.

Three different events and their conditions must be compared. The nominal seven-day removal-filing preset cannot determine the longest applicable period.

Which event starts this procedure?
Establish that the defendant did not answer before removal and read any order requiring repleading.
Preserve receipt of the initial pleading, actual summons service and whether the initial pleading was then on file.
Preserve removal-notice filing and compare every applicable candidate rather than assuming seven days controls.
FRCP 81(c)(2)Which timing conditions must be established?
- Identify the actual actor, pleading and required act.
- Establish the specified event and applicable order.
- Resolve the material conditions. This guide publishes no calculated date.
- Check final-day conditions and preserve service and filing evidence separately.
Establish each applicable event and its conditions. Apply Rule 6(a) to the respective periods and select the latest resulting candidate. A seven-day removal preset alone cannot implement the longest-of comparison.
Rule 6(a) excludes the operative event and counts intermediate calendar days. A final Saturday, Sunday or legal holiday moves forward. Rule 6(a)(6) includes federal and President or Congress declared holidays, plus state-declared holidays for forward periods in the district. Qualifying clerk inaccessibility matters separately for filing.
FRCP 6(a)(1)Why is no automated date published?
Three different events and their conditions must be compared. The nominal seven-day removal-filing preset cannot determine the longest applicable period.
Which conditions change the assessment?
- Receipt through service or otherwise
- Subsection (A) uses receipt of the initial pleading stating the claim for relief, through service or otherwise.
- Summons and pleading on file
- Subsection (B) uses service of the summons for an initial pleading on file at service.
- Removal and repleading
- Subsection (C) uses removal-notice filing. Rule 81(c)(2) says repleading is unnecessary unless the court orders it and applies these times to a defendant who did not answer before removal.
- This page does not establish effective service, merits, compliance or an actual court grant.
- Service and filing are different acts. Verify both when required.
