Which Texas survey completion and written-claim rules govern repose?
Section 16.011(a) generally requires its survey-error damages suit within ten years after completion for a survey completed on or after September 1, 1989. Earlier surveys use the later of September 1, 1991 or ten years after completion. A timely written claim has subsection (b)’s presentation rule. The repose period remains independent of other limitations.

Which events matter for this statutory condition?
Obtain the actual survey and establish completion and the surveyor’s covered registration or license.
Compare completion with September 1, 1989 to select the correct subsection (a) limb.
Preserve any written claim presented during the ten-year period and identify the independent limitation on the actual cause.
Texas CPRC 16.011(a)How must the complete timing condition be assessed?
- Obtain the actual survey and establish completion and the surveyor’s covered registration or license.
- Government Code 311.005(12) defines a year as twelve consecutive months. Section 311.014 supplies statutory computation. Select the actual statutory branch and establish every required event before applying a year count. For pre-September 1, 1989 completion, compare the ten-year completion endpoint with September 1, 1991 and use the later stated endpoint. Assess subsection (b) separately.
- The single ten-year preset does not implement the historical later-of comparison, timely written-claim relief or another applicable limitation.
Section 16.072 extends its statutory suit-filing period when the last day is a Saturday, Sunday or holiday to the next day county offices are open for business. Establish the actual county calendar. This guide does not determine a court filing hour or automatically apply that treatment to another act.
Texas CPRC 16.011(a)Why does this guide publish no calculated date?
The single ten-year preset does not implement the historical later-of comparison, timely written-claim relief or another applicable limitation.
Which conditions or exclusions change the assessment?
- Historical completion limb
- Subsection (a)(2) applies to completion before September 1, 1989 and selects the later of September 1, 1991 or ten years after completion.
- Timely presentation
- Subsection (b) requires presenting a written damages claim to the surveyor during the ten-year period, and specifies two years from presentation.
- Independent limitation
- Subsection (c) expressly calls this a statute of repose independent of any other limitations period. A repose endpoint does not establish timely suit under another period.
- This statutory-text review does not decide disputed facts, accrual, title, retrospective application or a court holding.
What evidence should be checked before acting?
