When can a Texas Rule 91a challenged-cause amendment lead to an amended motion?
If the respondent amends the challenged cause at least three days before hearing, the movant may withdraw the motion or file an amended motion directed to that cause before the hearing. A motion properly amended under Rule 91a.5(b) restarts the rule’s periods under .5(d). The pleading amendment alone does not automatically restart them. This guide calculates no date.

Which facts and events control this procedure?
Identify the cause challenged by the operative motion and actual hearing or submission.
Prove actual filing of the respondent’s amendment and its short-period lead interval.
Identify any movant withdrawal or amended motion filed before hearing in response to that amendment.
Texas Rule 91a.5(b)–(d)How does the required timing work?
- Identify the cause challenged by the operative motion and actual hearing or submission.
- Rule 4 excludes intermediate weekends and legal holidays for the three-day cause-amendment interval. Then assess the movant’s separate before-hearing action. Only an amended motion filed in accordance with .5(b) restarts the periods under .5(d).
- Read the actual order and confirm every stated condition.
- Complete the act required by the rule, not merely a date calculation.
Rule 4 excludes intermediate Saturdays, Sundays and legal holidays for periods of five days or less. The three-day period therefore needs the legally relevant holiday calendar, not an assumption that every weekday counts. Read the actual hearing or submission record and any controlling order. This guide calculates no backward result or automatic last-day adjustment.

Which conditions, exceptions or court directions matter?
- Actual amended motion restarts periods
- After a timely amendment of the challenged cause under Rule 91a.5(b), the movant may withdraw or file an amended motion directed to it before the hearing. An amended motion filed in accordance with that subdivision restarts Rule 91a’s periods under .5(d). The respondent’s amendment alone is not an automatic restart.
- Untimely amendments cannot simply replace the pleading considered
- Rule 91a.5(c) requires the court not to consider a nonsuit or amendment not filed as permitted by .5(a) or (b). Its stated party-agreement exception and actual motion history require assessment.
- Restart needs a corresponding amended motion
- Rule 91a.5(d) uses an amended motion filed in accordance with (b). The court’s forty-five-day ruling and the respondent’s response opportunity are described in the 2013 comment. Preserve the actual amended motion rather than choosing the pleading amendment date as a universal new trigger.
- This guide does not establish the actual pleadings, service, calendar, legal entitlement or terms of a signed order.
- The current consolidation date does not decide historical applicability of an individual amendment.
