When should a respondent answer an AAA Commercial Demand?
AAA Commercial Rule R-5(a) permits an answering statement within 14 calendar days after the AAA sends notice that the Demand was filed. The trigger is the AAA’s notice, not automatically receipt of the claimant’s Demand. File with the AAA and send copies to the claimant and other parties. No answer means the claim is deemed denied and does not delay the arbitration. Check actual extensions and procedural directions.

Responsible actor. The respondent filing an answering statement with the AAA and sending copies to all other parties.
Use the AAA notice of filing and its actual sending date. A claimant’s earlier service of a Demand is not the R-5(a) event.
Confirm the rules in effect when the administrative requirements for the Demand or submission were met. Rule R-1 allows a different agreed procedure and requires arbitrator consent to changes after appointment.
Read the current AAA case instructions, any mutual modification and any actual extension under R-43.
Separate the respondent’s Answer from a counterclaim, a reply to a counterclaim and an answer to a new or different claim. Each has its own procedural trigger.

AAA Commercial Arbitration Rules, R-5(a), PDF page 13How does this provision count time?
- Confirm the AAA Commercial rules and procedural track.
- Identify the AAA sending date from its notice.
- Read 14 calendar days after that date.
- Include intermediate weekends in the calendar arithmetic.
- Check actual AAA directions, agreements and extensions.
- File the answering statement with the AAA and send the required copies.
R-5(a) expressly uses 14 calendar days after the AAA sends the filing notice. The ordinary conditional illustration excludes that sending date. R-5(b) uses a separate AAA counterclaim-filing notice for the claimant’s reply. R-6(b) gives an answer period from transmittal of a new or different claim.
The reviewed Commercial Rules do not supply the same general receipt-country start and end rollover used by ICC Article 4, or JAMS Rule 8(f)’s express mail addition. Do not import either. A weekend endpoint, delivery problem or requested extension needs the actual AAA instruction, governing agreement or extension decision. R-43 permits mutual modification and good-cause extensions, with the stated award exception.
AAA Commercial Arbitration Rules, R-5(a), PDF page 13Which facts prevent one automatic date?
This is a procedural source guide for an optional Answer and related response branches. The route does not establish the applicable AAA notice, actual directions, variation or closed-day treatment needed for one automated date.
Under unmodified AAA Commercial R-5(a), the AAA sends its Demand-filing notice October 12, 2026. The respondent opens it October 14. No actual extension applies. R-5(a) uses the AAA sending date. Fourteen calendar dates after October 12 ends October 26, not October 28. This arithmetic does not establish delivery instructions or every procedural fact. Conditional ordinary arithmetic. October 26, 2026. The source guide gives no automated date.
The claimant serves the Demand October 1. The AAA sends notice of filing October 12, 2026. No modification or extension applies. The claimant’s service date is not the R-5(a) trigger. The ordinary arithmetic uses the AAA notice, giving October 26. Conditional AAA-notice illustration. October 26, 2026.
The AAA sends its notice Sunday October 4, 2026. Fourteen calendar days later is Sunday October 18. No actual AAA direction, agreed carry rule or extension has been supplied. The Commercial text reviewed does not establish ICC-style start carry or JAMS-style final carry. Do not invent Monday October 19 as the operative date. Confirm the applicable directions. No automatic carried date. October 18 is arithmetic only.
The AAA sends notice of filing the respondent’s counterclaim October 15, 2026. The claimant wishes to reply under R-5(b). No extension applies. The counterclaim-filing notice starts the distinct 14-calendar-day reply arithmetic, giving October 29. The original Demand notice does not start this reply. Conditional separate-reply illustration. October 29, 2026.
The AAA sends the Demand-filing notice October 12 and grants an R-43 extension expressly fixing November 3, 2026. Use the actual granted time limit. A pending request alone would not displace ordinary arithmetic. Read the granted November 3, 2026 limit.
Which conditions and exceptions apply?
- Answer is permissive, not automatic default liability
- R-5(a) allows an answering statement. If none is filed, the claim is deemed denied and the arbitration proceeds. That does not decide jurisdiction or the merits.
- Counterclaim is not universally due with the Answer
- R-5(b) permits a counterclaim after the AAA’s notice, subject to R-6 limitations. It requires its own contents, copies and fee. A claimant’s reply uses the AAA notice of filing the counterclaim.
- Jurisdiction objection requires separate attention
- R-7(c) requires a jurisdiction or arbitrability objection no later than the Answer to the claim or counterclaim giving rise to it. Do not rely on deemed denial alone.
- Actual variations and extensions
- Parties may mutually modify periods. The AAA or arbitrator may extend for good cause under R-43, subject to its award exception. Preserve the actual decision or agreement, not merely the request.
- AAA domestic Commercial Arbitration Rules. This source guide does not select Consumer, Employment, ICDR International or another procedure, and does not produce an automated or purchasable deadline.
- An optional answering statement, a counterclaim and a jurisdictional objection have different effects. Silence deems the claim denied, but does not excuse a late jurisdiction objection or establish a right to file any later counterclaim.
What must the responsible actor complete?
Questions about this procedure
When should a respondent answer an AAA Commercial Demand?
Does receiving the claimant’s Demand start the 14 days?
R-5(a) instead identifies the date the AAA sends its notice of filing. Preserve that notice. The claimant’s earlier service and the respondent’s later opening of an email are different facts.
AAA Commercial R-5(a), PDF page 13Does failing to answer admit the claim?
No. R-5(a) deems the claim denied and says that failure to answer does not delay the arbitration. The arbitration can continue.
AAA Commercial R-5(a), PDF page 13Must every counterclaim be filed within the Answer’s 14 days?
R-5(b) permits a counterclaim after the AAA’s filing notice, subject to R-6 limitations and any applicable directions. After appointment, new or different counterclaims require arbitrator consent.
AAA Commercial R-5(b) and R-6(b), PDF pages 13–14When does the claimant reply to a counterclaim?
R-5(b) permits a reply within 14 calendar days after the AAA sends notice of filing the counterclaim. That is a separate notice from the original Demand-filing notice.
AAA Commercial R-5(b), PDF page 14Can the AAA extend the response period?
R-43 allows the AAA or arbitrator to extend for good cause, subject to its stated exception. The parties may mutually modify periods. Check the actual extension and any post-appointment consent requirement.
AAA Commercial R-1(a) and R-43Did the 2026 download change the arbitration response rule?
The current official PDF still identifies its arbitration rules as effective September 1, 2022. June 1, 2026 identifies the mediation procedures in the same document. Confirm the actual arbitration edition.
