How long does an ICC tribunal have to render a final award?
Under the ordinary ICC Arbitration Rules 2026 Article 34, the President fixes the final-award time limit and may extend it. The President considers the procedural timetable or a reasoned tribunal request. There is no universal standard-track six-month period. Obtain the operative decision and check any later extension. Responsible actor. The arbitral tribunal rendering the final award within the time limit fixed or extended by the ICC President.
Confirm the edition under Article 1(2). The current rule applies to arbitrations commenced on or after June 1, 2026 unless an earlier edition was agreed.
Obtain the President’s actual fixing decision and any subsequent extension. The tribunal’s procedural timetable under Article 24(2) informs the decision but is not a substitute for it.
Verify whether Appendix V Expedited Procedure or Appendix VI HEAP applies. Those provisions take their own prescribed event and period. Do not transfer their periods into standard procedure.
Distinguish rendering the award from submitting a draft for scrutiny, approval of form and subsequent Secretariat notification.
The ordinary final-award limit under ICC 2026 Article 34. This guide does not calculate a date from the Terms of Reference, final hearing, initial CMC or receipt of the award. Confirm the actual procedure before applying a different appendix.
ICC Arbitration Rules 2026, Article 34How does this provision count time?
- Identify edition and procedure.
- Obtain the President’s current operative decision.
- Read the stated time limit and any conditions.
- Check all later extensions and the procedural timetable.
- Complete the Court scrutiny process before rendering.
- Record the actual award date and subsequent notification separately.
Ordinary Article 34 supplies no fixed period to add to a user-entered date. Read the actual time limit and any applicable communication rule. Appendix V Article 4 uses six months from the initial CMC. Appendix VI Article 7(1) uses three months from the initial CMC. Those are separate conditional procedures, not default substitutions for missing President directions.
A President-fixed date, an extension and any communication-based counting instruction must be read together. Article 4 cannot supply a missing period or identify a communication country from the seat alone. This guide does not automatically move a fixed date or compute an appendix month endpoint without the required procedure and calendar facts.
ICC Arbitration Rules 2026, Article 34Which facts prevent one automatic date?
Ordinary Article 34 is a case-specific President-fixed time limit. No universal fixed period can be computed from one event date.
Standard 2026 procedure applies. The President expressly fixes December 18, 2026 as the final-award limit. No later extension exists. Article 34 directs attention to the actual President decision. October 1 is a timetable date only and supplies no universal interval. Read the fixed December 18, 2026 limit. The source guide does not recompute it.
The President initially fixes December 18 and later expressly extends the limit to January 15, 2027. The actual extension decision is available. Use the latest operative fixing decision. A tribunal request alone would not establish the extension. Read the granted January 15, 2027 limit.
A standard-procedure instruction mentions Sunday December 20, 2026, but the actual President decision, communication country and any holiday treatment are not supplied. Article 34 supplies no universal addition, and the seat alone cannot resolve every Article 4 question. Obtain the actual decision and applicable time treatment. No assumed Monday date. Check the operative President decision.
An initial CMC occurred October 1, 2026, but the file does not establish standard procedure, Appendix V expedited procedure or Appendix VI HEAP. Article 34, Appendix V Article 4 and Appendix VI Article 7(1) use distinct mechanisms. Do not choose six or three months without establishing the procedure and extensions. No universal award date. Establish the procedural track.
Which conditions and exceptions apply?
- Actual decision controls
- Obtain the President’s original fixing decision and every extension. A reasoned tribunal request or draft timetable does not by itself establish approval.
- Special procedures are separate
- The expedited six-month and HEAP three-month provisions run from the initial CMC and allow President extensions. First establish the applicable appendix.
- Scrutiny precedes rendering
- Submission of a draft or completion of a hearing is not the rendered award. Court approval of the form is required before rendering.
- The ordinary final-award limit under ICC 2026 Article 34. This guide does not calculate a date from the Terms of Reference, final hearing, initial CMC or receipt of the award. Confirm the actual procedure before applying a different appendix.
- An institutional final-award timetable concerns the tribunal. It is distinct from a party’s court challenge, correction request, enforcement step or reply deadline.
What must the responsible actor complete?
Questions about this procedure
How long does an ICC tribunal have to render a final award?
Does every ICC final award have a six-month deadline?
No. Ordinary 2026 Article 34 requires the President to fix the time limit. The six-month period belongs to the distinct Expedited Procedure provision.
ICC 2026, Article 34 and Appendix V Article 4Does the tribunal’s timetable itself fix the Article 34 deadline?
The President takes that timetable into account. Obtain the President’s actual fixing decision or extension rather than treating the tribunal’s proposed date as the institutional deadline.
ICC 2026, Articles 24(2) and 34Who can extend the ordinary final-award time limit?
Article 34 gives the President the fixing and extension function. A tribunal request can inform that decision but does not itself prove that an extension was granted.
ICC 2026, Article 34What changes under Expedited Procedure?
Appendix V Article 4 ordinarily requires the award within six months from the initial CMC, subject to the President’s extension power. Establish that Appendix V applies before counting.
ICC 2026, Appendix V Article 4What changes under Highly Expedited Arbitration?
Appendix VI Article 7(1) ordinarily uses three months from the initial CMC, subject to President extension. HEAP requires its own agreement and procedural conditions.
ICC 2026, Article 33 and Appendix VI Articles 1 and 7(1)Is submitting the draft award the same as rendering it?
No. The Court scrutinizes the draft and must approve the form before the tribunal renders the award. Later Secretariat notification is another separate event.
