When may a respondent answer under JAMS Comprehensive Rules?

JAMS Comprehensive Rule 9(c) permits a response within 14 calendar days of service of the notice of claim. Submit it to JAMS and serve the other parties. Rule 8(f) adds three calendar days for U.S.-mail-only service and carries a Saturday, Sunday or legal-holiday final day. Check the actual service method, applicable holiday, extension and party-agreed procedure. An unanswered claim is deemed denied.

Responsible actor. The respondent submitting the response, defenses and any counterclaims to JAMS and serving the other parties.

Confirm Comprehensive Rules apply under Rule 1 and the edition under Rule 3. The Commencement Letter under Rule 5 establishes commencement for these Rules, but does not replace Rule 9’s service event.

For JAMS Electronic Filing System service, Rule 8(c) uses completed transmission to that system. A recipient’s later access does not itself reset the response.

For nonelectronic service under Rule 8(e), service is effective on deposit using an authorized method. If service occurs only by U.S. mail, Rule 8(f) adds three calendar days.

Keep any technical-error decision, extension, administrative suspension and agreed procedure. They can affect the operative response date.

JAMS Comprehensive Rules 8(f) and 9(c)–(f)

How does this provision count time?

  1. Confirm the Comprehensive rule set and edition.
  2. Establish the actual Rule 8 service method and completion or deposit.
  3. Identify the ordinary 14-calendar-day response period.
  4. Add three calendar days only if the notice was served only by U.S. mail.
  5. Carry a Saturday, Sunday or legal-holiday final day as Rule 8(f) requires.
  6. Apply the actual suspension, extension or agreed procedure.
  7. Submit to JAMS and serve all other parties.

Rule 9(c) uses 14 calendar days of service. Intermediate weekends count. Rule 8(f) adds three calendar days only for U.S.-mail-only service and expressly provides final-day weekend or legal-holiday carry. The conditional illustrations separately establish an agreed day-after-service starting convention and relevant legal-holiday facts; the bare text does not identify every jurisdiction’s legal holidays.

Rule 8(f) carries a Saturday, Sunday or other legal-holiday last day to the next nonholiday day. Establish the applicable legal holiday rather than substituting an ICC receipt-country calendar or the seat by default. Rule 8(d) permits relief for qualifying electronic transmission errors; a failed attempt does not silently become effective service. Rule 6(c) administrative suspension tolls other Rules and agreement periods.

The Comprehensive rules apply. An agreed procedure confirms that the day after effective service is day one. No administrative suspension, extension or conflicting direction applies. JAMS system service completes October 12, 2026. October 26 is not an applicable legal holiday. Under the established starting convention, count October 13 through October 26 as 14 calendar days. Electronic service does not qualify for the U.S.-mail-only addition. Conditional agreed-count illustration. October 26, 2026. No automated date.

The Comprehensive rules apply. An agreed procedure confirms that the day after effective service is day one. No administrative suspension, extension or conflicting direction applies. The notice is served only by U.S. mail, deposited October 12, 2026. October 29 is not a legal holiday. Rule 8(e) uses deposit and Rule 8(f) adds three calendar days to 14. Seventeen dates after October 12 ends October 29. Later opening of the envelope is not the stated service event. Conditional U.S.-mail-only illustration. October 29, 2026.

The Comprehensive rules apply. An agreed procedure confirms that the day after effective service is day one. No administrative suspension, extension or conflicting direction applies. Valid JAMS electronic service completes Sunday October 4, 2026. Monday October 19 is not an applicable legal holiday. The established 14-calendar-day count ends Sunday October 18. Rule 8(f) carries the final day to Monday October 19. It does not delay the start simply because service occurred Sunday. Conditional final-day carry illustration. October 19, 2026.

The Comprehensive rules apply. An agreed procedure confirms that the day after effective service is day one. No administrative suspension, extension or conflicting direction applies. The notice is validly served electronically October 12, 2026 and also mailed. October 26 is not a legal holiday. The paper was not served only by U.S. mail. Do not add the three days. The conditional agreed 14-day count ends October 26. Conditional mixed-service illustration. October 26, 2026.

An attempted JAMS transmission fails October 12, 2026. Successful completion, effective service and an actual Rule 8(d) decision are not established. A failed attempt is not automatically completed system service. Rule 8(d) provides discretionary relief and possible response extension. Obtain the actual decision and operative service date. No response date. Check technical-error relief and effective service.

Which conditions and exceptions apply?

Mail addition has a narrow condition
Three calendar days apply when the triggering paper is served only by U.S. mail. Hand delivery, overnight delivery and simultaneous valid electronic service do not establish that condition.
No response means denial, not admission
Rule 9(e) deems unanswered claims or counterclaims denied. Rule 9(f) separately addresses waiver of jurisdiction challenges unless asserted in a response or promptly when arbitrability circumstances first arise.
Actual extension and suspension
JAMS may grant reasonable response or counterclaim extensions before appointment under 9(c). The arbitrator has extension authority under 11(d), subject to its award exception. An administrative suspension tolls periods under 6(c).
Counterclaims and changed claims
A claimant may respond to a served counterclaim within 14 calendar days under 9(d). Rule 10 governs new or different claims and requires approval after appointment. Establish the actual service and procedural branch.
Transmission failure needs a decision
Rule 8(d) permits good-cause nunc pro tunc filing or service after technical error and related response relief. Preserve the actual decision instead of treating every failed attempt as timely.

What must the responsible actor complete?

Questions about this procedure

When may a respondent answer under JAMS Comprehensive Rules?

Does the JAMS Commencement Letter start the response period?

Rule 9(c) uses service of the notice of claim. The Commencement Letter has a different role under Rule 5. Establish actual Rule 8 service rather than substituting commencement.

JAMS Comprehensive Rules 5 and 9(c)

Do I receive three extra days for every delivery method?

No. Rule 8(f) adds three calendar days only when the triggering paper was served only by U.S. mail. Overnight delivery and JAMS electronic service do not establish that condition.

JAMS Comprehensive Rule 8(e)–(f)

What if the response period ends on Sunday?

Rule 8(f) carries the last day to the next day that is not a Saturday, Sunday or legal holiday. Confirm the relevant legal-holiday facts and actual variations.

JAMS Comprehensive Rule 8(f)

Does silence admit the claim or preserve a jurisdiction objection?

An unanswered claim is deemed denied under 9(e). Jurisdiction objections have a separate waiver rule in 9(f). A party must not assume deemed denial preserves every objection.

JAMS Comprehensive Rule 9(e)–(f)

When is an electronic filing complete?

Under Rule 8(a), filing completes when transmission to the JAMS system completes. An electronic filing by 11:59 p.m. in the sender’s time zone is deemed filed that date. Preserve completion evidence.

JAMS Comprehensive Rule 8(a)

Can JAMS or the arbitrator extend time?

JAMS may grant reasonable response or counterclaim extensions before appointment. After appointment, Rule 11(d) supplies the arbitrator’s extension authority, with its award exception. Check the actual decision and any suspension.
