When does permission to issue a writ cease to have effect?
Under CPR 83.2(7A), permission for issue of a writ of execution or writ of control ceases if the writ is not issued within one year after the permission order.
Responsible actor. The creditor relying on permission to issue the writ.
Date of the actual permission order.
Identify an actual permission order for a writ of execution or writ of control. An application for permission is not the order. Issue, rather than service or eventual execution, is the relevant completion event.

CPR 83.2(7A)–(7B)How does this provision count time?
- The ordinary period is one calendar year after the order. A model must separately resolve any closed final-day interaction between timely court issue and automatic lapse; no open-day extension is presumed for the automatic lapse condition.
- Where the corresponding final day is closed, do not assume the permission survives until the next open day. Establish the controlling issue and lapse rules before relying on that branch.

Fictitious example
The creditor relying on permission to issue the writ. The established event is Thursday, October 8, 2026. Use 12 calendar months, excluding the event date and reaching the corresponding calendar boundary. The endpoint is Friday, October 8, 2027. It identifies the stated boundary rather than a guaranteed successful filing or permission grant. Additional fictitious established facts. Fictitious individually specified facts. The listed context makes the actual branch, actors, event history and completion facts explicit. Additional dates below are stated hypothetical facts rather than inferred client records.

- Identified actor and operative event
- Identify an actual permission order for a writ of execution or writ of control. An application for permission is not the order. Issue, rather than service or eventual execution, is the relevant completion event.
- Provision-specific counting and closure
- The ordinary period is one calendar year after the order. A model must separately resolve any closed final-day interaction between timely court issue and automatic lapse; no open-day extension is presumed for the automatic lapse condition. Where the corresponding final day is closed, do not assume the permission survives until the next open day. Establish the controlling issue and lapse rules before relying on that branch.
- Required completion and separate procedural route
- If permission has ceased, rule 83.2(7B) permits a fresh permission order. Merely applying for fresh permission does not restore the expired order.
- Identify an actual permission order for a writ of execution or writ of control. An application for permission is not the order. Issue, rather than service or eventual execution, is the relevant completion event.
- The permission order’s life differs from the issued writ’s validity. CPR 83.3 or 83.4 governs the instrument after issue; rule 83.2(7A) governs whether existing permission remains effective before issue.

Questions about this procedure
When does permission to issue a writ cease to have effect?
Does filing a permission application start the one-year period?
No. Rule 83.2(7A) refers to the date of the permission order. Preserve the order the court actually granted.
CPR 83.2(7A)(a)–(b)Must the writ be executed within this permission year?
The stated condition is issue of the writ. Its subsequent validity and execution period are governed separately.
CPR 83.2(7A); 83.3(3); 83.4(3)Does the one-year permission rule expressly cover every warrant?
Rule 83.2(7A) identifies permission for issue of a writ of execution or writ of control. Do not expand that wording automatically to every warrant.
CPR 83.2(7A)(a)Can the creditor obtain fresh permission after the original order ceases?
Yes. Rule 83.2(7B) says the court may grant a fresh permission order. A further grant remains a court decision.
CPR 83.2(7B)Is a renewal request equivalent to an effective permission order?
No. The rule distinguishes the order the court grants from the creditor’s request. Retain the actual fresh order before relying on renewed permission.
CPR 83.2(7B)May a Saturday anniversary automatically become Monday for permission lapse?
That branch needs separate source review of the lapse condition and court-office act. A closed court office does not itself establish that the permission remains effective.
