TCG Regulations 2013, regs 2, 36–37How does this provision count time?
- Regulation 2 defines clear days. Preserve the removal and proposed sale as the endpoint events, leaving seven complete intervening dates for the ordinary branch.
- Regulation 37 does not import the special Sunday exclusions in regulations 6 and 25. Do not treat this as seven business days solely because those other notices use different calendars.

- Identified actor and operative event
- This waiting period starts with removal for sale. It does not start merely because a sale notice was drafted or delivered. Preserve the removal event and goods involved.
- Provision-specific counting and closure
- Regulation 2 defines clear days. Preserve the removal and proposed sale as the endpoint events, leaving seven complete intervening dates for the ordinary branch. Regulation 37 does not import the special Sunday exclusions in regulations 6 and 25. Do not treat this as seven business days solely because those other notices use different calendars.
- Required completion and separate procedural route
- Paragraph (2) permits sale the day after removal only on the stated nature-of-goods conditions. A wish to sell sooner or storage cost does not itself establish that exception.
- This waiting period starts with removal for sale. It does not start merely because a sale notice was drafted or delivered. Preserve the removal event and goods involved.
- Regulation 38 separately requires notice of the date, time and place of sale. Satisfying removal-to-sale waiting time does not itself satisfy the sale-notice requirement.

Questions about this procedure
How long after removal must controlled goods ordinarily wait before sale?
Does the minimum sale wait start when notice of sale is written?
No. Regulation 37(1) uses removal of the controlled goods for sale. Regulation 38 separately governs notice before sale.
TCG Regulations 2013, regs 37(1), 38(1)Is the ordinary waiting period seven business days after removal?
The provision says seven clear days. Its calendar is not the special Sunday-excluding notice calendar prescribed by regulations 6 and 25.
TCG Regulations 2013, regs 2, 37(1)Can controlled goods ever be sold the day after removal?
Paragraph (2) permits that where waiting would make them unsaleable or extinguish or substantially reduce value because of their nature or characteristics.
TCG Regulations 2013, reg 37(2)Does the paragraph (2) exception arise merely because storage is expensive?
The source states a nature-or-characteristics test concerning saleability or value. Establish those actual facts rather than replacing the test with a general preference for speed.
TCG Regulations 2013, reg 37(2)Does this seven-day sale waiting period apply to controlled securities?
Part 3 excludes securities under regulation 36. The securities provisions are separate, so the ordinary goods-sale branch must identify what was controlled.
TCG Regulations 2013, regs 36–37)Does completing the removal waiting period dispense with notice to a co-owner?
No. The separate sale-notice provisions require their own recipients and contents, including the co-owner where applicable.
