When must a non-bank third party notify the court of no or lesser debt?

CPR 72.6(4) requires a served non-bank third party claiming no debt or less than the specified amount to notify the court and creditor in writing within seven days.

Responsible actor. The served third party other than a bank or building society.

Actual effective service of the interim third party debt order.

Establish the non-bank status and the actual claim of no debt or a smaller debt. The rule describes this notification branch, not a generic bank-account disclosure.

How does this provision count time?

  1. Exclude effective service and include the seventh ordinary final date. Do not add an extra date merely because CPR 2.8 uses the term clear days.
  2. The court and judgment creditor are separate recipients. A claimed court-office carry does not itself extend the creditor communication; preserve both acts and completion methods.

Questions about this procedure

When must a non-bank third party notify the court of no or lesser debt?

Does every bank use the non-bank notification paragraph?

No. Paragraph (4) applies to a third party other than a bank or building society. Banks have the separate paragraphs (1)–(3) duties.

CPR 72.6(1)–(4)

What position triggers the non-bank written notification?

The served third party must claim that it owes nothing to the judgment debtor or owes less than the amount specified in the order.

CPR 72.6(4)(a)–(b)

Is an oral explanation to the creditor enough for paragraph (4)?

The rule requires notification in writing to the court and judgment creditor. Preserve the actual written communication and both recipients.

CPR 72.6(4)

Does the hearing date start this non-bank seven-day duty?

No. The duty runs from service of the interim order. The hearing date governs different service and evidence intervals elsewhere in Part 72.

CPR 72.6(4); 72.5

Does a within-seven-days duty omit the seventh day as well?

No. CPR 2.8(3) distinguishes the start date from an end defined by a reference event. The ordinary final act date is included.

CPR 72.6(4); 2.8(3), example (iii)

Does this notice decide whether the alleged debt actually exists?

It records the third party’s claim. The court’s consideration and any disputed evidence are separate from computing the notification period.
