What must the responsible actor complete?

Questions about this procedure

When must notice of qualifying re-entry be given?

Does Saturday count toward the statutory two-clear-day re-entry notice?

An ordinary Saturday counts. Regulation 25(2) lists Sundays and specified holidays, without the CPR short-period Saturday exclusion.

TCG Regulations 2013, reg 25(1)–(2)

Can Friday and Saturday precede a Monday re-entry as the two clear days?

Yes in an ordinary interval without a specified holiday. Sunday does not count, and the notice and re-entry dates remain outside the two counted dates.

TCG Regulations 2013, regs 2, 25(1)–(2)

Does any earlier visit authorize use of this re-entry notice branch?

No. The notice is tied to the source-defined re-entry power. Preserve the controlled goods agreement and the particular breach rather than assuming a lawful power from a previous visit.

TCG Regulations 2013, regs 2, 25–26)

Must the re-entry notice identify the breached agreement?

Regulation 26 requires identifying agreement and repayment details, how the debtor failed to comply, and the other prescribed contents.

TCG Regulations 2013, reg 26(d)–(j)

Can the enforcement agent shorten the re-entry notice without a court order?

Regulation 25(3) gives that power to the court, with the stated dissipation condition in paragraph (4). Preserve the actual order if the ordinary interval is shortened.

TCG Regulations 2013, reg 25(3)–(4)

Does a compliant two-day interval establish the time of day for re-entry?

No. The notice period and the separate entry or re-entry hours and power conditions must each be satisfied.
