When must an affected party object to a consolidated attachment application?

CPR 89.19(6)(b) requires an affected party to notify the court in writing, with reasons for any objection, within fourteen days of service of the notification.

Responsible actor. An affected party electing to object to the consolidated attachment application.

Effective service on that party of the court officer’s paragraph (6) notification.

Identify whether the debtor or a creditor applied, because paragraph (1) defines the affected parties differently. Use the notification served on the actual objector.

CPR 89.19(1), (6)–(10)

How does this provision count time?

  1. Exclude the notification-service day and include the fourteenth calendar day. An ordinary weekend inside this fourteen-day period still counts.
  2. The written objection is notification to the court. Any claim to next-open-day completion must establish the actual court-office act and closure under CPR 2.8(5), not simply extend every party’s service deadline.

Which conditions and exceptions apply?

Identified actor and operative event
Identify whether the debtor or a creditor applied, because paragraph (1) defines the affected parties differently. Use the notification served on the actual objector.
Provision-specific counting and closure
Exclude the notification-service day and include the fourteenth calendar day. An ordinary weekend inside this fourteen-day period still counts. The written objection is notification to the court. Any claim to next-open-day completion must establish the actual court-office act and closure under CPR 2.8(5), not simply extend every party’s service deadline.
Required completion and separate procedural route
If no objection is notified within time, paragraph (7) requires the court officer to make the consolidated order. A timely objection produces referral to the District Judge, who may still grant the application after considering it.
CPR 89.19(1), (6)–(10)
  • Identify whether the debtor or a creditor applied, because paragraph (1) defines the affected parties differently. Use the notification served on the actual objector.
  • This objection concerns whether to consolidate orders. It is distinct from reconsidering the terms of an attachment order under rule 89.7 and from an employer’s request for consolidation under paragraph (9).

What must the responsible actor complete?
