When must an objection to a CNBC final charging order be filed and served?

CPR 73.10(2) requires written evidence of objection to be filed and served on the judgment creditor within twenty-eight days after the objector receives the application notice and interim order.

Responsible actor. The person actually objecting to the final charging order.

Effective service on that person of both application notice and interim order.

The untransferred CNBC paper route must apply. The source completion is both filing and service of written grounds, not merely an informal statement of disagreement.

CPR 73.10(2), (6A)

How does this provision count time?

  1. Exclude the qualifying service date and include the twenty-eighth ordinary final date. Establish that both documents were served; an incomplete bundle does not silently supply the source event.
  2. Filing and creditor service are separate acts. A court-office closure may affect filing without automatically extending service on the creditor; mixed closed-day cases require separate completion analysis.

Which conditions and exceptions apply?

Identified actor and operative event
The untransferred CNBC paper route must apply. The source completion is both filing and service of written grounds, not merely an informal statement of disagreement.
Provision-specific counting and closure

A court-office closure may affect filing without automatically extending service on the creditor; mixed closed-day cases require separate completion analysis.
Required completion and separate procedural route
Rules 73.10(3)–(6) use objections and the last person’s period for transfer or later consideration. They do not give every objector the last recipient’s later deadline.
CPR 73.10(2), (6A)
  • The untransferred CNBC paper route must apply. The source completion is both filing and service of written grounds, not merely an informal statement of disagreement.
  • The hearing-fixed objection branch in rule 73.10A(2) uses at least seven days before hearing. The CNBC paper branch uses the person’s own actual service event.

What must the responsible actor complete?

Questions about this procedure

When must an objection to a CNBC final charging order be filed and served?

Does an objection email to the court alone satisfy the paper-track rule?

The rule requires both filing and service on the judgment creditor of written evidence stating the grounds. Preserve both completion acts.

CPR 73.10(2)(a)–(b)

Does the earliest recipient’s service start every objector’s twenty-eight days?

Paragraph (2) refers to service on that person. Preserve each actual objector’s qualifying service event.

CPR 73.10(2)

What happens when written grounds of objection are filed?

Paragraph (3) requires transfer for a hearing to the debtor’s home court, with transfer timing governed by paragraph (4).

CPR 73.10(3)–(4)

Can an objector wait for the last recipient’s objection period?

Paragraph (2) sets that person’s own period. The last recipient’s period helps control transfer or consideration timing; it does not replace the objector’s deadline.

CPR 73.10(2), (4), (6)

Does the CNBC twenty-eight-day objection apply after transfer for hearing?

Rule 73.10(1) identifies the untransferred CNBC branch. Rule 73.10A supplies the hearing-route evidence requirement.

CPR 73.10(1); 73.10A(1)–(2)

Is a final order made automatically on the first day after one objector’s period?

Paragraph (6) refers to expiry for the last person served, and the court or legal adviser must consider the application within the stated powers. Do not substitute an automatic first-recipient result.
