Check the applicable procedure
The enactment must make the compromise enforceable or recoverable if the court orders. A conditional compromise requires the payee to do something beyond discontinuing or not starting proceedings. Establish both gates before selecting this procedure. If no response is filed within time, paragraph (7A)(a) says the court will make the order. A timely response does not assure refusal of enforcement. The court makes such order as appears appropriate.

CPR 70.5(1)–(7A)How does this provision count time?
- The ordinary filed-response period excludes effective service day and includes the fourteenth calendar day. It is not a fourteen-day minimum before an already fixed hearing.
- The response is filed at court, so a qualifying actual court-office closure can engage CPR 2.8(5). This guide does not supply a date without the statutory gateway, operative service and actual completion facts.

Questions about this procedure
When may a respondent oppose enforcement of a conditional compromise?
What makes a compromise conditional for this application?
The payee must do something in addition to discontinuing or not starting proceedings. That is the definition in paragraph (4A), not a generic label for every settlement condition.
CPR 70.5(4A)Does every settlement require a court order under rule 70.5(3)?
No. Paragraph (3) applies where an enactment makes the decision or compromise enforceable, or the sum recoverable, if the court so orders. Establish that enactment.
CPR 70.5(1), (3)May this route be used as the default procedure for an arbitration award?
No. Arbitration awards are expressly excluded by paragraph (2)(b). Their separate enforcement procedure must be checked.
CPR 70.5(2)(b)Must opposition take the form of a filed response?
Paragraph (7A) describes opposition by filing a response within fourteen days of service of the application notice. A private objection alone does not establish that filing.
CPR 70.5(7A)What happens if the respondent files no timely response?
Paragraph (7A)(a) says the court will make the order. The absence of a response is therefore materially different from a timely contested application.
CPR 70.5(7A)(a)Does a timely response require the court to reject enforcement?
No. Paragraph (7A)(b) says the court will make such order as appears appropriate. The response preserves a contested decision, not a guaranteed outcome.
