How does this provision count time?

  1. Exclude the order date and include the twenty-first ordinary final date. The instruction is within twenty-one days, rather than twenty-one complete intervening days.
  2. Service on recipients is not automatically extended by a closed court office. Effective-service method and actual directions must be established for any closed final-date scenario.

Questions about this procedure

When must a CNBC interim charging order bundle be served?

Does every interim charging order use twenty-one days after the order?

No. Paragraph (1) requires the untransferred CNBC route. Paragraph (5) uses at least twenty-one days before hearing for the other identified route.

CPR 73.7(1), (5)

What must the creditor serve on the CNBC paper track?

Copies of the interim order, application notice and supporting documents must be served on the paragraph (7) recipients.

CPR 73.7(1), (7)

Does serving the debtor complete every CNBC charging-order recipient?

Not necessarily. Paragraph (7) also identifies applicable co-owners, spouse or civil partner, creditors, trustees and asset-specific recipients.

CPR 73.7(7)

Is the service certificate due twenty-one days after each recipient’s service?

Paragraph (2) sets a separate twenty-eight-day period from the interim order for the certificates and amount statement. It does not start anew on each service.

CPR 73.7(2)

Where must a request to extend the CNBC service period be made?

Paragraph (3) requires the application at CNBC and provides disposal without a hearing. The requested extension is separate from an actual grant.

CPR 73.7(3)

Does missing ordinary CNBC service automatically discharge the interim order immediately?

Rule 73.10(6B) states the legal adviser’s unless-order or referral route in the prescribed circumstances. Do not substitute an automatic immediate discharge for that process.
