When does an ordinary non-TCG writ or warrant expire?

CPR 83.3(3) makes a relevant non-TCG writ or warrant valid for twelve months beginning with its issue date, subject to actual extension.

Responsible actor. The creditor or enforcement officer checking the instrument’s validity.

Actual issue date of the relevant non-TCG writ or warrant.

Rule 83.3 applies to the relevant non-TCG instruments identified in paragraph (1). A writ of control using the taking-control-of-goods procedure belongs to rule 83.4 instead.

How does this provision count time?

  1. Include the issue day. For an ordinary corresponding-date example, the final validity day is the day before the twelve-month anniversary. Preserve an actual extension and any qualifying Part 85 application separately.
  2. Automatic instrument validity does not continue merely because its final day is Saturday or the court office is closed. The ordinary validity expiry stays on that final date.

What do independently checked examples show?

Fictitious example

The creditor or enforcement officer checking the instrument’s validity. The established event is Friday, October 9, 2026. Use 12 calendar months beginning with that date, so the last valid day is the corresponding anniversary minus one day. The endpoint is Friday, October 8, 2027. It identifies the stated boundary rather than a guaranteed successful filing or permission grant. Additional fictitious established facts. Fictitious individually specified facts. The listed context makes the actual branch, actors, event history and completion facts explicit. Additional dates below are stated hypothetical facts rather than inferred client records.

Which conditions and exceptions apply?

Identified actor and operative event
Rule 83.3 applies to the relevant non-TCG instruments identified in paragraph (1). A writ of control using the taking-control-of-goods procedure belongs to rule 83.4 instead.
Provision-specific counting and closure
Include the issue day. For an ordinary corresponding-date example, the final validity day is the day before the twelve-month anniversary. Preserve an actual extension and any qualifying Part 85 application separately. Automatic instrument validity does not continue merely because its final day is Saturday or the court office is closed. The ordinary validity expiry stays on that final date.
Required completion and separate procedural route
The writ’s validity period includes its issue day. Its expiry remains distinct from an application-filing deadline or a later court-office opening.
CPR 83.3(1), (3)
  • Rule 83.3 applies to the relevant non-TCG instruments identified in paragraph (1). A writ of control using the taking-control-of-goods procedure belongs to rule 83.4 instead.
  • A non-TCG validity clock starts with issue. A TCG writ’s ordinary validity is linked to the regulation 9 notice-based period, so the issue date cannot replace the notice date there.

What must the responsible actor complete?

Questions about this procedure

When does an ordinary non-TCG writ or warrant expire?

Does the day of issue count toward twelve-month writ validity?

Yes. Rule 83.3(3) states that the period begins with the date of issue. Its ordinary final day precedes the corresponding anniversary.

CPR 83.3(3)

Does a writ of control always use the issue date for validity?

No. Relevant TCG writs and warrants are governed by rule 83.4, which links validity to regulation 9’s notice-based period.

CPR 83.3(1); 83.4(1), (3)

Does Saturday expiry automatically extend a non-TCG writ until Monday?

No automatic extension appears in rule 83.3(3). Validity expiry is distinct from an act at the court office under CPR 2.8(5).

CPR 83.3(3); 2.8(5)

Can the court extend a non-TCG writ’s validity?

Rule 83.3(4) allows court extensions for a period of twelve months at any one time at one time. An actual grant, not a requested renewal, establishes an extended period.

CPR 83.3(4)–(6)

Does a Part 85 claim always extend an already expired writ?

Rule 83.3(11) requires the Part 85 application during the writ’s validity. An application after expiry does not satisfy that condition.

CPR 83.3(11)

What must happen before an extended writ is executed?

Rule 83.3(7) requires the prescribed court sealing or sealed notice to the enforcement officer. A warrant is handled by endorsement under paragraph (8).

CPR 83.3(7)–(8)
