Responsible actor. Party bringing a competent non-national-security appeal from an Employment Tribunal decision in Scotland.
Establish actual sending of the written judgment or qualifying written full reasons, or actual date of the order, direction or other decision.
The underlying Employment Tribunal sat in Scotland and the appropriate receiving office is EAT Edinburgh. This is a non-national-security initial appeal raising an actual point of law, not a Registrar appeal, cross-appeal or another procedure.
Only the exact ordinary source branch is supported. The actual event, route, applicable current regime and completion facts must be established.
Employment Appeal Tribunal Rules 1993 rr 3(1),(3),37(1A),(2); EAT Practice Direction 2026 sections 3.3,3.4; ET Procedure Rules 2024 r 60(4A)-(4E)How does this provision count time?
- Exclude the actual source event. Count 42 calendar days.
- Rule 37(2) uses the actual appropriate EAT office closure and next opening, where closure prevents the act. Confirm every relevant Edinburgh office closure. National bank holidays and local court closures do not automatically close that office.
- Complete the actual required notice and supporting documents through the statutory route and within its cutoff.
Exclude the actual source event. Count 42 calendar days.
Rule 37(2) uses the actual appropriate EAT office closure and next opening, where closure prevents the act. Confirm every relevant Edinburgh office closure. National bank holidays and local court closures do not automatically close that office.

- Source condition 1
- The underlying Employment Tribunal sat in Scotland and the appropriate receiving office is EAT Edinburgh. This is a non-national-security initial appeal raising an actual point of law, not a Registrar appeal, cross-appeal or another procedure.
- Source condition 2
- The actual underlying Employment Tribunal decision was sent to the parties on or after March 2,2026. The current 2026 Practice Direction and amended Rules apply. A qualifying reasons date alone does not establish that edition.
- Source condition 3
- The selected actual written-judgment, qualifying-full-reasons or dated-order event applies. A summary-reasons document, receipt date, later correspondence, reconsideration request or unresolved remedy is not substituted.
- Source condition 4
- For oral-full-reasons, the actual full-reasons request was made at the hearing or received within 14 days after sending the written judgment. For oral-summary-reasons with later requested full reasons, the summary request was timely and the full request was received within 14 days after sending written summary reasons.
- Source condition 5
- For the Tribunal-election branch, a timely request for written summary reasons was actually made and the Tribunal provided written full reasons under Rule 60(4E). For the reserved branches, the actual decision or oral-reasons facts meet the selected 2026 condition.
- Source condition 6
- The complete Form 1 appeal and required documents must reach the appropriate Edinburgh office by 4 pm UK local time. A link to stored files, incomplete documents or a transmission still in progress does not complete the appeal.
- Source condition 7
- I checked the actual EAT Edinburgh office calendar and listed every relevant closure. If Rule 37(2) is used, the office closure prevents the act on that date. Scottish bank holidays and local court closures are not automatically EAT office closures.
- Source condition 8
- No actual extension, abridgment, different enactment or court order changes this ordinary 42-day period. Later reasons outside the qualifying routes and reconsideration do not restart it.
- Only the exact ordinary source branch is supported. The actual event, route, applicable current regime and completion facts must be established.
- A decision, notice receipt, full reasons, summary reasons, determination expiry and taking-effect date are different events. Use the selected actual source event.

No. The 2026 direction distinguishes five qualifying full-reasons routes. They include reserved decisions or reasons, timely requests following oral full reasons, the two timely requests after oral summary reasons, and the Tribunal’s Rule 60(4E) election. A summary document, late request, reconsideration or later correspondence does not automatically start a new period.
