Responsible actor. Eligible tenant or planning applicant using the exact statutory procedure.

Establish actual date specified in the enforcement notice as the date on which it is to take effect.

This is an enforcement notice under the 1997 Act. I am a person served with it or another person having an interest in the land, with an actual available section 130 ground. Another planning notice or appeal uses a different route.

The section 130 appeal must precede the actual taking-effect date. This identifies the prior calendar date only. The chosen method must satisfy its own giving, ordinary delivery or ordinary transmission test and any operative cutoff. It does not establish appeal competence, service validity or an extension.

Does posting the appeal on the last calendar date always complete it?

No. The prepaid-post branch requires a properly addressed prepaid letter sent when it would ordinarily be delivered before the taking-effect date. Electronic communication has its own ordinary-transmission test. The prior calendar date does not replace those requirements.

Town and Country Planning (Scotland) Act 1997 ss 127,128(8),130(1)-(3)

How are weekends and closures handled?

The requirement is before the actual taking-effect date. No automatic weekend, holiday or office-closure extension applies. The selected giving, ordinary-post or ordinary-transmission test remains required.
