When is a Florida response to an amended pleading due?

Under current Rule 1.190(a), a party must plead in response to an amended pleading within ten days after actual service of that amended pleading, unless the court otherwise orders. Do not count from the amendment motion’s filing, the grant of leave alone or the original complaint’s service. Establish the actual amended document and any controlling court-set response time.

How does Florida count this civil period?

  1. Obtain the actual amended pleading and evidence of its service.
  2. Rule 1.090(a) incorporates Rule 2.514(a). Exclude the established event. For seven days or longer, begin with the next day that is not Saturday, Sunday or a legal holiday. Count intermediate calendar days. For fewer than seven days, omit intermediate Saturdays, Sundays and legal holidays. Do not treat a seven-day period as seven business days.
  3. Check the observed statutory holidays, actual clerk calendar and chief-justice directions.
  4. Complete the required act with the proper court or recipient.

Apply the observed New Year’s Day, Martin Luther King Jr. birthday, Memorial Day, Independence Day, Labor Day, Veterans’ Day, Thanksgiving Day, Friday after Thanksgiving and Christmas Day holidays. Section 110.117 observes Saturday holidays on the preceding Friday and Sunday holidays on the following Monday. Rule 2.514 also includes clerk-observed holidays and days designated by the chief justice or chief judge. An ineligible final day moves in the counting direction. The bundled Florida calendar covers 2026 through 2028. Verify additional closures and chief-justice extensions separately.

Which Florida civil qualifications change the procedure?

Actual service supplies the event
Rule 1.190(a) measures the response from service of the amended pleading. Filing a motion seeking leave or an order granting leave does not by itself prove service of the authorized amended pleading.
The court can prescribe another response time
Rule 1.190(a) expressly preserves another court-ordered response time. Read the actual order before using the default ten-day arithmetic. This calculator does not infer an extension from an ungranted request.
A supplemental pleading requires separate treatment
Under Rule 1.190(d), the court may permit a supplemental pleading and, if it deems a response advisable, order that response and specify its time. Do not automatically apply this amendment response period to a supplement.
A more definite statement has its own branches
Rule 1.140(a)(3),(4) supplies the stated order-filing and statement-service response procedures. Establish that document and actual order instead of treating every clarification as an amended pleading.
