When does Rule 6(d) add three days after service?
Rule 6(d) adds three days when a party must or may act within a specified time after being served under Rule 5(b)(2)(C), (D) or (F). Compute the underlying period under Rule 6(a) first. Electronic service under (E) is excluded. This is a conditional addition to another period, not a standalone three-day filing deadline.
- Period
- Three additional days after the underlying Rule 6(a) period would otherwise expire
- Trigger
- The properly computed expiry of the underlying qualifying service-based period
- Rule
- FRCP 6(d)

Establish the actual procedure and conditions
A base-period expiry and qualifying service method must first be established. The isolated three-day preset cannot safely reconstruct those facts and publishes no date.

Which event starts this procedure?
Identify the actual rule requiring action within a specified time after being served.
Identify effective service and whether its method is Rule 5(b)(2)(C), (D) or (F).
Compute the base Rule 6(a) expiry before adding the conditional three days. Recheck the resulting final day.
FRCP 6(d)Which timing conditions must be established?
- Identify the actual actor, pleading and required act.
- Establish the specified event and applicable order.
- Resolve the material conditions. This guide publishes no calculated date.
- Check final-day conditions and preserve service and filing evidence separately.
Establish effective service and apply Rule 6(a) to the base period. Rule 6(d) adds three days only to a specified period after being served under Rule 5(b)(2)(C), (D) or (F). Compute the underlying Rule 6(a) expiry first, then add three days and recheck the final day. Electronic service under (E) and office or dwelling delivery under (B) do not qualify. Filing, judgment entry, one’s own service and backward lead times do not automatically attract the addition. This guide does not select a service method or compute a date.
Rule 6(a) excludes the operative event and counts intermediate calendar days. A final Saturday, Sunday or legal holiday moves forward. Rule 6(a)(6) includes federal and President or Congress declared holidays, plus state-declared holidays for forward periods in the district. Qualifying clerk inaccessibility matters separately for filing.
FRCP 6(a)(1)Why is no automated date published?
A base-period expiry and qualifying service method must first be established. The isolated three-day preset cannot safely reconstruct those facts and publishes no date.
Which conditions change the assessment?
- Qualifying methods
- Mail under (C), leaving with the clerk under (D) and other means consented to under (F) are the specified methods.
- Electronic service excluded
- Electronic service under Rule 5(b)(2)(E) and office or dwelling delivery under (B) are outside Rule 6(d)’s list.
- Correct underlying event
- The period must run after being served. Filing, entry of judgment and a backward hearing period do not automatically qualify.
- This page does not establish effective service, merits, compliance or an actual court grant.
- Service and filing are different acts. Verify both when required.
What should I verify before acting?
Common questions
This procedure and its conditions
Does electronic service add three days?
No. Rule 6(d) lists (C), (D) and (F), rather than electronic service under (E).
FRCP 6(d)Are the days added before applying Rule 6(a) to the base period?
No. Add them after the underlying period would otherwise expire under Rule 6(a), then check the resulting final day.
FRCP 6(d)Does mailing an order always add three days?
No. Establish whether the specific action period runs after being served and whether the actual Rule 5 method qualifies. Mailing alone does not answer that question.
