What does the Rule 11 sanctions safe harbor require?

It must not be filed or presented if the challenged matter is withdrawn or appropriately corrected within twenty-one days after service or another time the court sets. This is a correction opportunity before presentation, rather than a last filing deadline.

Which event starts this procedure?
Preserve the separate motion and its description of the specific alleged Rule 11(b) conduct.
Establish service of the actual motion under Rule 5 and its method.
Check any actual different court time and whether the challenged matter was withdrawn or appropriately corrected.
FRCP 11(c)(2)Which timing conditions must be established?
- Identify the actual actor, pleading and required act.
- Establish the specified event and applicable order.
- Resolve the material conditions. This guide publishes no calculated date.
- Check final-day conditions and preserve service and filing evidence separately.
Establish effective service and apply Rule 6(a) to the base period. Rule 6(d) adds three days only to a specified period after being served under Rule 5(b)(2)(C), (D) or (F). Compute the underlying Rule 6(a) expiry first, then add three days and recheck the final day. Electronic service under (E) and office or dwelling delivery under (B) do not qualify. Filing, judgment entry, one’s own service and backward lead times do not automatically attract the addition. This guide does not select a service method or compute a date.
Rule 6(a) excludes the operative event and counts intermediate calendar days. A final Saturday, Sunday or legal holiday moves forward. Rule 6(a)(6) includes federal and President or Congress declared holidays, plus state-declared holidays for forward periods in the district. Qualifying clerk inaccessibility matters separately for filing.
FRCP 6(a)(1)Why is no automated date published?
This safe harbor combines service method, actual court time and a correction condition. A simple twenty-one-day result must not be sold as a filing deadline or permission to file.
Which conditions change the assessment?
- Separate motion and correction
- The motion must be separate. Timely withdrawal or appropriate correction prevents filing or presentation under this branch.
- Court initiative is separate
- Rule 11(c)(3) separately permits a show-cause order on the court’s own initiative. This motion safe harbor does not define that procedure.
- Discovery excluded
- Rule 11(d) excludes disclosures, discovery requests, responses, objections and motions under Rules 26 through 37.
- This page does not establish effective service, merits, compliance or an actual court grant.
- Service and filing are different acts. Verify both when required.
What should I verify before acting?
Common questions
This procedure and its conditions
Is the end of the safe harbor the last date to file?
No. The text restricts filing or presentation when correction or withdrawal occurs in the stated opportunity. It does not establish a universal last filing date.
FRCP 11(c)(2)Does a warning letter establish service of the required motion?
The text requires service of the separate motion under Rule 5. Establish that actual service rather than treating a warning as the motion.
FRCP 11(c)(2)Does this page govern the court’s own show-cause order?
No. Court-initiated action is separately addressed in Rule 11(c)(3).
