What starts the Illinois Supreme Court petition-for-leave period?
Rule 315 ordinarily allows thirty-five days after the applicable Appellate Court judgment entry. A timely rehearing petition invokes the actual denial, modified decision on denial or judgment on rehearing branch. A timely Rule 23 publication motion has its own granted-or-denied disposition branch. Establish the actual events and eligibility before choosing the petition deadline.

Illinois Supreme Court Rule 315(a)–(f)How is this Illinois appellate period counted?
- Establish that discretionary Supreme Court leave is available for this decision under Rule 315(a).
- Exclude the independently established triggering day and count intermediate calendar days under 5 ILCS 70/1.11. A filing, entry, effective service or previously established due date must come from its actual record. Do not substitute one event for another. Select the applicable event before counting; do not assume every corrected opinion restarts the period.
- Check statutory holidays and the proper court’s actual calendar.
- Complete the particular act in the proper court.
Section 1.11 excludes a final Saturday, Sunday or statutory holiday and consecutive excluded days. Section 17(a) of the Promissory Note and Bank Holiday Act includes Pulaski Day, Good Friday and the general election for members of the House of Representatives. Check proclamations, the proper court’s actual calendar and clerk access separately. The bundled Illinois calendar covers 2026 and 2027.

Which qualifications and court directions matter?
- Supreme Court leave is discretionary and eligibility matters
- Rule 315(a) addresses cases not appealable as of right. Its Workers’ Compensation Commission division branch requires at least two panel judges to join the stated substantial-question certification. The prescribed certification request has its own rehearing-time condition.
- Timely rehearing selects the actual disposition branch
- Rule 315(b)(1) uses denial entry, the entry of a modified decision issued on denial, or judgment entry on granted rehearing as applicable. A corrected opinion without a rehearing petition does not extend the leave period.
- A timely Rule 23 publication motion changes its branch
- Rule 315(b)(2) uses opinion filing when the publication motion is granted or the order denying publication when it is denied. Filing that motion does not invalidate a previously filed leave petition. The Appellate Court clerk transmits the stated motion and disposition notices to the Supreme Court clerk.
- Extensions are exceptional and require actual relief
- Rule 315(b)(1) allows the Supreme Court or a judge to extend on motion only in the most extreme and compelling circumstances. Do not assume an extension from the request alone.
- The optional answer uses petition expiry
- Rule 315(f) permits an answer within twenty-one days after the time for filing the petition expires, or actual further time granted. It uses petition expiry, not early actual petition filing, and prohibits a reply to that answer.
- The calculator does not decide appealability, disputed facts, sufficiency of a filing or whether the court grants relief.
- Check the governing edition and actual orders. A current rule does not establish every historical appeal’s timetable.
