When does Illinois’s two-year medical malpractice discovery period expire?

For covered licensed patient-care claims, Section 13-212(a) measures two years from the earliest actual knowledge, reasonable knowledge or written notice of injury or death. The separate four-year act-based period can control earlier. This calculator measures the discovery component only.

Which of knowledge, reasonable knowledge and written notice occurred first?

Confirm a covered licensed defendant and a claim arising out of patient care.

Establish actual knowledge, reasonable-knowledge and written-notice dates, then enter the earliest qualifying date.

Preserve the alleged causative act date and compare the four-year component separately.

How do discovery and the act-based period interact?

  1. Confirm a covered licensed defendant and a claim arising out of patient care.
  2. Count two calendar years from the earliest of the three qualifying events. This output does not automatically compare the four-year act-based limit or resolve exceptions.
  3. Check the final weekend, statutory holiday and the proper court’s actual calendar.
  4. Commence the patient-care action within the applicable combined limits. Preserve knowledge, notice and act evidence. Review the Section 2-622 affidavit, certificate and report duties separately.

Section 1.11 excludes a final Saturday, Sunday or statutory holiday and consecutive excluded days. Section 17(a) of the Promissory Note and Bank Holiday Act includes Pulaski Day, Good Friday and the general election for members of the House of Representatives. Check proclamations, the proper court’s actual calendar and clerk access separately. The bundled Illinois calendar covers 2026 and 2027.

What does an independently derived example show?

Fictitious example

Use the ordinary adult discovery component after comparing all three events. Compare the separate four-year period before treating any date as the claim’s filing boundary. Minor, disability, concealment and fertility-fraud provisions need separate review. Fictitious statutory event, independently established under the precise scope stated in this guide. Use the ordinary adult discovery component after comparing all three events. Compare the separate four-year period before treating any date as the claim’s filing boundary. Minor, disability, concealment and fertility-fraud provisions need separate review.

Which qualifications change this statutory calculation?

The defendant and patient-care scope matter
Subsection (a) addresses physicians, dentists, registered nurses and hospitals duly licensed in Illinois for injury or death arising out of patient care, whether pleaded in tort, contract or otherwise.
The earliest event controls discovery
Actual knowledge, knowledge attributable through reasonable diligence and written notice are alternatives. The statute selects whichever occurs first, not the most recent communication.
The four-year component must also be checked
The ordinary subsection (a) act-based period runs from the alleged causative act, omission or occurrence. A discovery count alone does not establish that commencement remains available.
Minority and disability are distinct statutory branches
Subsection (b) addresses under-eighteen claims with an eight-year act-based period and twenty-second-birthday qualification. Subsection (c) addresses other disability at accrual. Subsection (d) addresses later disability and does not invalidate repose.
Concealment and fertility fraud are express exceptions
Subsection (a) expressly excepts Sections 13-215 and 13-215.1. The latter’s fertility-fraud periods and alternative triggers require their own classification, not an automatic two-year substitution.
The report deferral does not extend claim commencement
Section 2-622(a)(2) permits the stated ninety-day certificate and report deferral after a qualifying complaint affidavit. It does not automatically extend the malpractice filing limitation.
735 ILCS 5/13-212(a)–(d)
  • This calculation does not determine whether relief is available or whether the facts satisfy the statute.
  • A current statutory edition does not establish the law for every historical claim. Preserve the applicable edition and actual orders.
