What notice is needed to seek dissolution or modification of a Texas no-notice TRO?

The adverse party may appear and seek dissolution or modification of a TRO granted without notice after giving the obtaining party two days’ notice, or shorter notice the court prescribes. Rule 4 excludes intermediate Saturdays, Sundays and legal holidays for this short period. The court must address the motion as expeditiously as justice requires. Notice does not itself dissolve the order. This guide calculates no date.

Which facts and events control this procedure?

Establish the actual motion proceeding and any court order prescribing shorter notice.

Select and preserve a permitted service method and actual completed notice to the required recipient.

Texas Rule 680

How does the required timing work?

  1. Obtain the no-notice TRO and identify the party who obtained it.
  2. The ordinary two-day notice period is five days or less under Rule 4, so intermediate Saturdays, Sundays and legal holidays are excluded. A court-prescribed shorter notice must be established from the actual order. Do not replace service completion with the motion drafting date.
  3. Read the actual order and confirm every stated condition.
  4. Complete the act required by the rule, not merely a date calculation.

Rule 4’s short-period exclusion matters to the ordinary two-day branch. Its qualifying-mail-addition exception is a different provision. Read the actual court calendar, service method and shortened-notice order. This guide applies no automatic backward closed-day adjustment or inferred shortening.

Why is no fixed date calculated?

The backward two-day preset cannot establish the actual hearing, completed service, shortened-notice order or dissolution ruling. This guide explains the complete motion procedure without a computed last date or paid record.

Which conditions, exceptions or court directions matter?

Correct TRO and recipient
The stated Rule 680 branch concerns an order granted without notice and requires notice to the party who obtained that order. Identify the actual order and recipient.
Shorter notice needs court action
The court may prescribe shorter notice. The adverse party cannot infer shortening merely from urgency or its preferred hearing time.
Short-period computation
Rule 4 excludes intermediate weekends and legal holidays in a rule-prescribed period of five days or less, with its separate mail-addition exception. The ordinary two-day interval is not two unrestricted calendar days.
Actual motion determination
Rule 680 directs the court to hear and determine the dissolution or modification motion as expeditiously as justice requires. That direction does not supply a fixed automatic ruling date or dissolve the order upon service.

  • This guide does not establish the actual pleadings, service, calendar, legal entitlement or terms of a signed order.
  • The current consolidation date does not decide historical applicability of an individual amendment.
