United States · Texas statutory limitations

Which sale, warranty and exposure facts control Texas products-liability repose?

Section 16.012(b) generally requires commencement before the end of fifteen years after the defendant’s product sale. It does not apply to a lease. A longer expressly warranted useful safe life, the stated latent-disease allegations, related accrual protection and the aviation exclusion require separate assessment. Other action limitations remain independent.

Which events matter for this statutory condition?

Establish the defendant manufacturer or seller, actual sale and the section 16.012(a) products-liability action.

Obtain any written useful-safe-life warranty and preserve first-sale, exposure, disease and symptom records.

Check the lease and aviation exclusions and every other governing action limitation.

Texas CPRC 16.012

How must the complete timing condition be assessed?

  1. Establish the defendant manufacturer or seller, actual sale and the section 16.012(a) products-liability action.
  2. Government Code 311.005(12) defines a year as twelve consecutive months. Section 311.014 supplies statutory computation. Select the actual statutory branch and establish every required event before applying a year count. Preserve the statutory words before the end. Subsection (c) instead uses the expressly warranted longer useful safe life after the stated sale. Exposure branches require their full different event set.
  3. The single fifteen-year preset cannot assess the warranty, multiple latent-disease events, sale-versus-lease or aviation exclusion, or establish the statutory before-the-end boundary.

Section 16.072 extends its statutory suit-filing period when the last day is a Saturday, Sunday or holiday to the next day county offices are open for business. Establish the actual county calendar. This guide does not determine a court filing hour or automatically apply that treatment to another act.

Why does this guide publish no calculated date?

The single fifteen-year preset cannot assess the warranty, multiple latent-disease events, sale-versus-lease or aviation exclusion, or establish the statutory before-the-end boundary.

Which conditions or exclusions change the assessment?

Longer written useful safe life
Subsection (c) requires an express written warranty of useful safe life longer than fifteen years, and uses the warranted years after the stated sale. A general quality promise alone does not establish that condition.
Latent-disease allegations
Subsection (d) requires its exposure before fifteen years, causal disease and symptoms not manifesting sufficiently to put a reasonable person on injury notice within its specified period. Subsection (d-1) separately protects the stated cause’s limitation where accrual occurs before the repose period ends.
Related accrual protection
Subsection (d-1) does not reduce a limitation for a subsection (d) cause accruing before the end of this section’s period.
Sale, not lease
Subsection (f) applies this section only to sale, not lease, of the product.
Federal aviation exclusion
Subsection (g) excludes claims to which the General Aviation Revitalization Act of 1994 or its exceptions apply. This Texas source guide identifies that boundary without determining the federal Act’s application.
Independent limitation
Subsection (e) does not extend the action period imposed under another law.
