Which deadline governs a Texas appraisal or appraisal-review claim?

Except for fraud or breach of contract, section 16.013(b) requires suit on a covered appraisal or appraisal-review claim by the earlier of two years after actual or constructive knowledge of the relevant facts and five years after completion. Neither limb alone establishes the deadline. This guide calculates no date.

Which events matter for this statutory condition?

Identify the appraisal or appraisal review and its actual completion date.

Establish when the claimant knew or should have known the facts on which the action is based.

Classify the claim. Fraud and breach of contract are expressly outside this provision.

Texas CPRC 16.013(b)

How must the complete timing condition be assessed?

  1. Identify the appraisal or appraisal review and its actual completion date.
  2. Assess both statutory periods and take the earlier applicable endpoint. Government Code 311.005(12) and 311.014 address calendar units; they do not choose knowledge or completion facts.
  3. The isolated catalog presets provide only one date each. They cannot establish both events, take the earlier endpoint or classify the express exclusions.

Section 16.072 extends its statutory suit-filing period when the last day is a Saturday, Sunday or holiday to the next day county offices are open for business. Establish the actual county calendar. This guide does not determine a court filing hour or automatically apply that treatment to another act.

Which conditions or exclusions change the assessment?

Fraud and contract claims excluded
Section 16.013(b) excepts an action for fraud or breach of contract. This guide does not select the separate governing limitation for those claims.
Covered professional and work
Read section 16.013(a). The appraiser, appraisal firm and appraisal or review must satisfy the specified definitions. This guide does not establish licensure or classify disputed work.
Texas CPRC 16.013(b)
  • This statutory-text review does not decide disputed facts, accrual, title, retrospective application or a court holding.

What evidence should be checked before acting?

Common questions

This statutory procedure

Can I use five years if I learned the relevant facts earlier?

No. Section 16.013(b) selects the earlier of its knowledge and completion periods. Both events must be established.

Texas CPRC 16.013(b)

Does this same comparison decide a fraud claim?

No. Fraud and breach of contract are expressly excepted. Establish the limitation governing the actual claim separately.

Texas CPRC 16.013(b)

Does knowledge mean only when I actually discovered the facts?

The statute includes when the person should have known the facts. This guide does not decide constructive knowledge.
