When must a Texas court send additional or amended findings?
The court sends any additional or amended findings within ten days after that request is filed under Rule 298. Rule 298 gives the court ten days after the additional request is filed. The requesting party’s earlier ten-day period instead follows the court’s sending of originals. The same number does not make those events or actors interchangeable. This is a court duty. Which conditions, exceptions or court directions matter?
- Specified timely additional request
- The party’s request concerns specified additional or amended findings, made within ten days after the court sends originals and served on each party under Rule 21a. Assess any claimed sending-method adjustment separately.
- Actual sending under the stated procedure
- The court sends any additional or amended findings to the parties under Rule 21(f)(10). Drafting, an internal file or a party’s later reading does not itself establish the sending event.
- No deemed or presumed findings
- Rule 298 expressly states that failure to make additional findings does not deem or presume findings or conclusions. This court-duty period is not a device that automatically grants the requested facts.
- This guide does not establish the actual pleadings, service, calendar, legal entitlement or terms of a signed order.
- The current consolidation date does not decide historical applicability of an individual amendment.
