When must additional or amended Texas findings and conclusions be requested?
After the court sends original findings and conclusions, Rule 298 allows a request for specified additional or amended findings within ten days after that sending event. File it with the clerk and serve each party under Rule 21a. This calculator covers ordinary verified electronic sending without a claimed mail addition. Court sending, draft preparation, filing and later reading are not automatically the same event.

Which event starts this filing period?
Obtain the court’s original findings and conclusions and proof of actual electronic sending.
Identify the specified additions or amendments requested, not merely general disagreement with the judgment.
Prepare clerk filing and service on each party. Assess any different sending method or claimed mail addition separately.
Texas Rule 298How is this ordinary period counted?
- Obtain the court’s original findings and conclusions and proof of actual electronic sending.
- Confirm the stated branch and actual triggering record.
- Exclude the event and count 10 calendar days.
- Check the final day and complete the specific required act. A court ruling, operation-of-law event and party filing are distinct.
Rule 4 excludes the triggering event and counts intermediate calendar days for these periods longer than five days. A final Saturday, Sunday or legal holiday moves to the next day that is not one of those days. Establish the actual legal holidays, court calendar and any additional closure. Government Code 662.021 identifies the checked Labor Day holiday in the examples; an ordinary office schedule alone does not establish every legally eligible expiry day.
Enter actual verified electronic sending, not a draft, judgment signing or later reading. This preset does not select a claimed mail adjustment or another communication branch.
Texas Rule 4How does the independently derived example work?
Fictitious example
Fictitious ordinary facts. The court’s actual sending of its original findings and conclusions occurred August 2, 2027. The stated ordinary branch applies without a different start, exception, additional closure or controlling order.
| Step | What is counted | Date |
|---|---|---|
| Actual event | The court’s actual sending of its original findings and conclusions | August 2, 2027 |
| Ordinary period | Exclude the event and add 10 calendar days | Thursday, August 12, 2027 |
Fictitious facts and the stated ordinary branch only. Actual orders, case facts and legal holidays require separate checking. The closed-day example assumes the next identified day is otherwise eligible.
Try these dates in the calculatorWhich facts change this filing analysis?
- Actual originals sent
- Current Rule 298 uses when the court sends the original findings and conclusions. A judgment-signing date or draft date does not replace that actual event.
- Specified additions or amendments
- The request concerns specified additional or amended findings or conclusions. The calculator does not decide which findings are necessary or whether the request properly preserves an issue.
- Service and other sending methods
- Rule 298 requires service on each party under Rule 21a. This preset uses ordinary verified electronic court sending without a claimed mail addition. A different method or claim of added time requires separate analysis and is not calculated here.
- Separate court duty and no automatic presumption
- Within ten days after the additional request is filed, the court must send any additional or amended findings by the stated Rule 21(f)(10) procedure. The court’s failure does not itself deem or presume findings or conclusions.
- This preset does not establish jurisdiction, preservation, legal sufficiency, proof of a different start or the actual local calendar.
- The result remains provisional until the required facts, rule and order are checked.

Common questions about this filing
When must additional or amended Texas findings and conclusions be requested?
Do I count from judgment signing or the original request filing?
This Rule 298 request runs from when the court sends the original findings and conclusions, a different event from those earlier procedures.
Texas Rule 298Does merely reading the originals later start ten fresh days?
The rule uses the court’s sending event. Later reading alone is not substituted by this ordinary preset.
Texas Rule 298Does the court’s failure automatically create my requested findings?
No. Rule 298 expressly states that failure to make additional findings does not deem or presume them.
