United States · Florida appellate procedure

When may a Florida appellee designate additional transcript portions?

Within twenty days after actual notice-of-appeal filing, the appellee may designate additional proceedings for transcription and must serve the designation on the qualified reporter or transcriptionist under Rule 9.200(b)(1). Establish necessary portions and satisfactory cost arrangements. The event is original notice filing, not the appellant’s designation or later transcript receipt.

How does Florida count this appellate period?

  1. Obtain actual original notice filing and identify needed additional proceedings.
  2. Rule 9.420(e) incorporates Rule 2.514(a). Exclude the established event. For seven days or longer, begin with the next day that is not Saturday, Sunday or a legal holiday. Count intermediate calendar days. For fewer than seven days, omit intermediate Saturdays, Sundays and legal holidays. Do not treat a seven-day period as seven business days.
  3. Check the observed statutory holidays, actual clerk calendar and chief-justice directions.
  4. Complete the required act with the proper court or recipient.

Apply the observed New Year’s Day, Martin Luther King Jr. birthday, Memorial Day, Independence Day, Labor Day, Veterans’ Day, Thanksgiving Day, Friday after Thanksgiving and Christmas Day holidays. Section 110.117 observes Saturday holidays on the preceding Friday and Sunday holidays on the following Monday. Rule 2.514 also includes clerk-observed holidays and days designated by the chief justice or chief judge. An ineligible final day moves in the counting direction. The bundled Florida calendar covers 2026 through 2028. Verify additional closures and chief-justice extensions separately.

Which Florida appellate qualifications change the procedure?

Transcript designations carry payment arrangements
Rule 9.200(b)(1) initially places designated transcript costs on the designating party, subject to later cost taxation. Unless other satisfactory arrangements exist, pay half the estimated cost on designation and the balance on delivery. Preserve the actual arrangements and receipts.
The reporter acknowledgment and extension are separate acts
Rule 9.200(b)(2) requires the reporter’s endorsed acknowledgment, service and filing within five days of designation service. Inability to finish within thirty days requires a reasoned extension request, a five-day party objection or agreement opportunity and the court’s decision identifying the transcript due date. A request alone is not a grant.
This is optional additional designation
Rule 9.200(b)(1) permits appellee additional portions. Establish whether needed proceedings are already on file or covered by the appellant’s designation before adding transcripts.
Later delivery creates a different service duty in its stated branch
Rule 9.200(b)(3) requires the designating party who directed delivery to fewer than all parties to serve the designated transcripts on other parties within ten days of actual receipt. That later duty does not restart this designation period.
