United States · Florida appellate procedure
When must a Florida appellant designate needed transcript portions?
Within ten days after actual notice-of-appeal filing, the appellant must designate the proceedings not on file deemed necessary for transcription and inclusion, and serve that designation on the approved reporter or transcriptionist under Rule 9.200(b)(1). Prepare the designation, required service and actual satisfactory payment arrangements.
Florida Rule of Appellate Procedure 9.200(b)(1)How does Florida count this appellate period?
- Obtain actual notice-of-appeal filing and identify necessary proceedings not already on file.
- Rule 9.420(e) incorporates Rule 2.514(a). Exclude the established event. For seven days or longer, begin with the next day that is not Saturday, Sunday or a legal holiday. Count intermediate calendar days. For fewer than seven days, omit intermediate Saturdays, Sundays and legal holidays. Do not treat a seven-day period as seven business days.
- Check the observed statutory holidays, actual clerk calendar and chief-justice directions.
- Complete the required act with the proper court or recipient.
Apply the observed New Year’s Day, Martin Luther King Jr. birthday, Memorial Day, Independence Day, Labor Day, Veterans’ Day, Thanksgiving Day, Friday after Thanksgiving and Christmas Day holidays. Section 110.117 observes Saturday holidays on the preceding Friday and Sunday holidays on the following Monday. Rule 2.514 also includes clerk-observed holidays and days designated by the chief justice or chief judge. An ineligible final day moves in the counting direction. The bundled Florida calendar covers 2026 through 2028. Verify additional closures and chief-justice extensions separately.
Florida Rule of General Practice and Judicial Administration 2.514(a)What do the independently derived facts show?
Fictitious example
Fictitious facts. The notice is actually filed and necessary proceedings not on file require a qualified reporter designation. The independently established event is August 2, 2027. No additional holiday, mail-only addition, tolling or different order applies.
| Step | What is counted | Date |
|---|---|---|
| Established event | Actual notice-of-appeal filing for the established Rule 9.200(b)(1) appellant designation | August 2, 2027 |
| Applicable period | Ten calendar days after actual notice filing for the needed transcript designation | Thursday, August 12, 2027 |
Fictitious facts. Establish the stated procedure and actual event separately. No mail-only addition, further clerk holiday, tolling motion, chief-justice extension or different actual court order is assumed.

- Transcript designations carry payment arrangements
- Rule 9.200(b)(1) initially places designated transcript costs on the designating party, subject to later cost taxation. Unless other satisfactory arrangements exist, pay half the estimated cost on designation and the balance on delivery. Preserve the actual arrangements and receipts.
- The reporter acknowledgment and extension are separate acts
- Rule 9.200(b)(2) requires the reporter’s endorsed acknowledgment, service and filing within five days of designation service. Inability to finish within thirty days requires a reasoned extension request, a five-day party objection or agreement opportunity and the court’s decision identifying the transcript due date. A request alone is not a grant.
- Already filed transcripts and newly needed proceedings differ
- Rule 9.200(a)(1) includes applicable transcripts already filed. Paragraph (b)(1) addresses proceedings not on file deemed necessary for transcription and record inclusion. Establish what actually needs a new designation.
- The appellee may designate additional portions
- Rule 9.200(b)(1) permits appellee additional portions within twenty days of notice filing, with prescribed reporter service and separate initial cost responsibility.
- This page does not establish appealability, jurisdiction, disputed facts, sufficiency or an extension.
- Check the governing historical edition, actual motions, orders, clerk holidays and filing receipts.
