United States · Federal appellate reply and service timing

When does federal appellate service add three days?

FRAP 26(c) adds three days after a service-based period otherwise expires under Rule 26(a). The paper must be neither served electronically on the party nor delivered to that party on the date stated in the proof of service. Establish the underlying period and its expiry first. This is not three days from the service date.

Which base period and service qualify?

Identify the actual provision requiring or permitting an act within a specified time after service.

Read the service method, proof date and actual delivery evidence. Rule 25(c)(4) distinguishes service completion from actual receipt.

Compute the base period under Rule 26(a) before adding anything. Rule 26(c) does not supply the length or trigger of the underlying procedure.

FRAP 26(c)

Why does one isolated period not resolve this procedure?

  1. Identify a service-based underlying period.
  2. Verify both non-electronic service and absence of delivery on the proof date.
  3. Compute and roll the base expiry under Rule 26(a).
  4. Add three days after that expiry and check final-day treatment and separate constraints.

Establish the service date under Rule 25 and compute the base service-based period under Rule 26(a), including its final-day rollover. Rule 26(c) adds three days after that base otherwise expires only when the paper was neither served electronically on the party nor delivered to that party on the proof-of-service date. Apply Rule 26(a) to the added period. This addition does not change the separate argument-based filing limit.

FRAP 26(a)(1) excludes the triggering event, counts intermediate calendar days and carries a final Saturday, Sunday or legal holiday to the next qualifying day. Rule 26(a)(5) continues backward for a period measured before an event. Rule 26(a)(6) includes federal and President or Congress declared holidays. Its additional state-declared holidays apply only to forward periods, using the challenged district court’s state or the circuit clerk’s principal-office state. Check actual calendars, inaccessibility and orders.

Why is no automated result published?

Eligibility, the underlying period, its rolled base expiry and any coupled limit require separate facts. The isolated three-day preset remains unavailable for calculation or paid records.

Which conditions require separate review?

Electronic service
Electronic service does not qualify. The filing system’s electronic notification is not a generic three-day entitlement.
Actual same-date delivery
Non-electronic service alone is insufficient when the paper was delivered to the party on the proof-of-service date. Verify delivery rather than assuming that mail always qualifies.
Different triggers
Entry-based, filing-based and argument-based periods do not become service-based because a document was also served. A notice-of-appeal deadline receives no Rule 26(c) addition merely from judgment notice.
FRAP 26(c)
  • Eligibility, the underlying period, its rolled base expiry and any coupled limit require separate facts. The isolated three-day preset remains unavailable for calculation or paid records.
  • The guide does not establish disputed service, read actual orders, grant relief or verify a court’s completed acts.

What should I verify before filing and service?

Common questions

When does federal appellate service add three days?

Can I enter the service date in an isolated three-day calculator?

That would omit the underlying period. Rule 26(c) adds after the base otherwise expires under Rule 26(a). This guide intentionally publishes no isolated date.

FRAP 26(c)

Does mail service wait until the paper arrives?

Rule 25(c)(4) makes mail or commercial-carrier service complete on mailing or carrier delivery. Rule 26(c) separately considers actual delivery on the proof date. Keep completion and eligibility distinct.

FRAP 25(b)–(d)

Does every fixed date in an order gain three days?

Rule 26(c) applies when a party acts within a specified time after being served. An independently fixed calendar date is not automatically that kind of period. Read the actual order and governing provision.
