When may an Illinois appellee designate additional transcript portions?

Within seven days after service of the docketing statement and transcript request, the appellee may serve the appellant with a designation of additional proceedings needed in the report. Establish service of both documents. The appellant then has a separate seven-day response to that designation. The designation is a service act, not the reporter’s forty-nine-day filing.

How is this Illinois appellate period counted?

  1. Obtain the actual docketing statement and transcript request.
  2. Exclude the independently established triggering day and count intermediate calendar days under 5 ILCS 70/1.11. A filing, entry, effective service or previously established due date must come from its actual record. Do not substitute one event for another.
  3. Check statutory holidays and the proper court’s actual calendar.
  4. Complete the particular act in the proper court.

Section 1.11 excludes a final Saturday, Sunday or statutory holiday and consecutive excluded days. Section 17(a) of the Promissory Note and Bank Holiday Act includes Pulaski Day, Good Friday and the general election for members of the House of Representatives. Check proclamations, the proper court’s actual calendar and clerk access separately. The bundled Illinois calendar covers 2026 and 2027.

Which qualifications and court directions matter?

The report must include pertinent evidence
Rule 323(a) requires all evidence pertinent to appeal issues and permits the specified rulings, reasons and proceedings. Identify actual missing portions rather than assuming the existing request is complete.
The appellant has a separate response
Within seven days after designation service, the appellant must request the designated portions or move in the trial court to exclude them unless the appellee advances cost.
Unnecessary material can affect costs
The reviewing court may assess the expense of unnecessary or immaterial report material against the party who designated it regardless of the appeal outcome.
The initial request accompanies docketing
Rule 323(a) requires the appellant’s written transcript request within Rule 312’s filing time. Rule 312(b) requires applicable written requests with the docketing statement and service with proof.
Illinois Supreme Court Rule 323(a)
  • The calculator does not decide appealability, disputed facts, sufficiency of a filing or whether the court grants relief.
  • Check the governing edition and actual orders. A current rule does not establish every historical appeal’s timetable.
