United States · Illinois civil appeals
When must an Illinois appellant serve a proposed bystander’s report?
If no verbatim transcript is obtainable, the appellant may prepare a proposed report from the best available sources and serve all parties within twenty-eight days after notice filing. Other parties have a separate amendment stage, followed by presentation on notice and trial-court settlement and certification. Illinois Supreme Court Rule 323(c)How is this Illinois appellate period counted?
- Establish actual notice filing and unavailability of a verbatim transcript.
- Exclude the independently established triggering day and count intermediate calendar days under 5 ILCS 70/1.11. A filing, entry, effective service or previously established due date must come from its actual record. Do not substitute one event for another.
- Check statutory holidays and the proper court’s actual calendar.
- Complete the particular act in the proper court.
Section 1.11 excludes a final Saturday, Sunday or statutory holiday and consecutive excluded days. Section 17(a) of the Promissory Note and Bank Holiday Act includes Pulaski Day, Good Friday and the general election for members of the House of Representatives. Check proclamations, the proper court’s actual calendar and clerk access separately. The bundled Illinois calendar covers 2026 and 2027.

- Available recordings can inform the proposal
- Rule 323(c) permits preparation from the best available sources, including recollection, and allows a party to request a court recording at the party’s expense for transcription and preparation.
- Amendment and presentation are later stages
- Other parties may serve amendments or an alternative proposal within fourteen days after proposed-report service. The appellant then presents the proposals and amendments on notice in the rule’s subsequent seven-day stage.
- Certification requires the actual trial-court process
- The trial court settles, certifies and orders an accurate report filed, holding hearings if needed. Absent stipulation, only the certified report is included in the record.
- A stipulated agreed statement is distinct
- Rule 323(d) permits a written stipulated statement of material facts, filed without certification in lieu of and within the report-filing period. It is not created by unilateral proposed-report service.
- Report extensions require a supported reviewing-court motion
- Rule 323(e) permits a motion before original or extended expiry or within thirty-five days thereafter. Support it with an affidavit showing necessity. After expiry, also show reasonable excuse for not filing the motion earlier. Serve the preparing clerk. Relief requires an actual order.
- The calculator does not decide appealability, disputed facts, sufficiency of a filing or whether the court grants relief.
- Check the governing edition and actual orders. A current rule does not establish every historical appeal’s timetable.
