United States · Federal appellate transcript procedure

When may the appellee designate additional transcript parts?

FRAP 10(b)(3)(B) gives the appellee fourteen days after service of the appellant’s order or certificate and issues statement to file a designation of additional necessary transcript parts and serve it on the appellant. FRAP 26(c) may add three days. This isolated preset does not calculate the service-dependent addition.

Which event starts this transcript procedure?

Confirm that the appellant did not order the entire transcript.

Establish actual service of the transcript order or certificate and the issues statement.

Identify the additional parts considered necessary.

Preserve the service method, actual delivery facts and applicable directions.

FRAP 10(b)(3)(B)

Why is no combined deadline calculated?

  1. Identify the exact required act and responsible person.
  2. Establish service or actual completion conditions.
  3. Read any applicable addition or granted time.
  4. Complete the required acts using the actual court and reporter instructions.

Establish the actual service method and delivery date. FRAP 26(c) adds three calendar days after the base period otherwise expires unless the paper was served electronically or delivered on the date stated in the proof of service. The isolated preset does not collect these facts or calculate this addition.

FRAP 26(a)(6) includes federal holidays and days declared holidays by the President or Congress. For a period after an event, it also includes holidays declared by the state where the challenged district court or circuit clerk’s principal office is located. The national calendar does not infer additional state holidays, actual inaccessibility or local directions.

Why is no automated date shown?

The fourteen-day preset omits the possible FRAP 26(c) addition and does not collect service or delivery conditions. No computed date or paid calculation record is published.

Which conditions change the transcript procedure?

Both required documents
The national trigger refers to service of the order or certificate and statement of issues, not notice filing or reporter receipt.
File and serve
The appellee must file the designation and serve it on the appellant within the applicable period.
Possible added days
FRAP 26(c) requires the actual service and delivery conditions. Nonelectronic service alone does not establish every condition.
Later appellant duty
Rule 10(b)(3)(C) separately addresses the appellant’s order of all designated parts and notice to the appellee after designation service.
FRAP 10(b)(3)(B)
  • This guide does not select the necessary transcript, classify a motion, infer actual service or read court directions.
  • Authorized direct bankruptcy appeals and district-court/BAP appellate bankruptcy appeals have separate Rule 6 record procedures.
