United States · Federal appellate transcript procedure
What must a court reporter do if the transcript cannot be completed within thirty days?
Under FRAP 11(b)(1), the reporter records order receipt and expected completion and sends the endorsed order to the circuit clerk. If completion within thirty days is impossible, the reporter may request additional time from that clerk. The rule does not make day thirty a fixed deadline before which every extension request must be filed.
- Period
- Thirty-day completion reference, with actual additional time granted by the circuit clerk
- Trigger
- Reporter receipt of the transcript order and the actual inability to complete within thirty days
- Rule
- FRAP 11(b)(1)

Which event starts this transcript procedure?
Establish the reporter’s actual receipt of the transcript order.
Read the receipt date and expected completion date endorsed on the order.
If completion within thirty days is impossible, identify the actual additional-time request and circuit-clerk action.
Distinguish receipt, expected completion, a request, granted time and completed-transcript filing.
FRAP 11(b)(1)Why is no combined deadline calculated?
- Identify the exact required act and responsible person.
- Establish service or actual completion conditions.
- Read any applicable addition or granted time.
- Complete the required acts using the actual court and reporter instructions.
Rule 11(b)(1)(B) describes inability to complete within thirty days of receipt and permits a request for additional time. It does not state one universal request-filing deadline or grant a fixed extension. Read the actual clerk action and resulting completion instructions.
FRAP 26(a)(6) includes federal holidays and days declared holidays by the President or Congress. For a period after an event, it also includes holidays declared by the state where the challenged district court or circuit clerk’s principal office is located. The national calendar does not infer additional state holidays, actual inaccessibility or local directions.
FRAP 26(a)(4)–(6), (b) and (c)Why is no automated date shown?

Which conditions change the transcript procedure?

- Additional time requires clerk action
- Rule 11(b)(1)(B) permits the reporter to request additional completion time. The clerk records the action on the docket and notifies the parties.
- Completed transcript filing
- When complete, Rule 11(b)(1)(C) requires filing the transcript with the district clerk and notifying the circuit clerk of that filing.
- Failure to file on time
- Rule 11(b)(1)(D) requires the circuit clerk to notify the district judge and do whatever else the court of appeals directs if the reporter fails to file on time.
- This guide does not select the necessary transcript, classify a motion, infer actual service or read court directions.
- Authorized direct bankruptcy appeals and district-court/BAP appellate bankruptcy appeals have separate Rule 6 record procedures.
