Which event starts the CPLR 3133(a)-(c) period?
Preserve the actual written interrogatories, valid personal service and the identities of all parties who must receive the response.
Confirm that interrogatories are permitted in this action. CPLR 3130 restricts combining interrogatories with a bill of particulars and, in specified negligence actions, depositions of the same party without leave.
Responsible actor. The party served with valid written interrogatories. Permitted written interrogatories and valid personal service under the ordinary CPLR 3133 branch only. Matrimonial nonparty financial orders, unsupported methods, different orders, protective motions and granted extensions are excluded.
CPLR 3133(a)-(c)How is this service or filing period counted?
- Preserve the actual written interrogatories, valid personal service and the identities of all parties who must receive the response.
- Confirm that interrogatories are permitted in this action. CPLR 3130 restricts combining interrogatories with a bill of particulars and, in specified negligence actions, depositions of the same party without leave.
- Exclude the established event day and count 20 calendar days forward. Intermediate weekends and public holidays count. General Construction Law 25-a permits the next succeeding business day for a closed final statutory day.
- Serve each party with the answers and any particularized objections. Give separate full written sworn answers, with each question preceding its answer, through the responding person identified in CPLR 3133(b).
General Construction Law 20 excludes the established event day. Intermediate Saturdays, Sundays and public holidays count in these fifteen-, twenty-, sixty- and 120-day calendar periods. Section 25-a permits the next succeeding business day for a closed final statutory day and expressly includes a period before which an act is required. The backward notice-to-admit boundary still requires the actual trial date and separate opening condition.
The independently derived 2026 and 2027 calendar follows General Construction Law 24 and Election Law 8-100. It includes Lincoln’s Birthday, Flag Day on the second Sunday in June, Juneteenth, general election day and the other specified holidays. Section 24 adds the next day when a listed holiday falls on Sunday, except Flag Day. A Saturday holiday is not automatically observed on Friday under this provision. Additional appointed holidays and actual court or system closures require separate proof.
These calculators cover established events and final dates within January 1, 2026 through December 31, 2027. They require the disclosed statutory branch, independently valid service, no unsupported method addition, no different actual court order and no additional closure. The backward notice-to-admit preset requires an actual open-day trial date and an independently established opening condition. Earlier editions, the 2020 executive-order toll and dates beyond the retained calendar require separate review and receive no computed or paid date. This software coverage boundary does not establish that an actual act is late.

- Each party receives the response
- Section 3133(a) requires service upon each party, rather than only the party who sent the interrogatories. Preserve the actual entitled recipients.
- Sworn written answers
- An individual answers under oath. For the identified entities, an officer, director, member, agent or employee with the information answers. Each question receives a separate full answer.
- Use restrictions
- CPLR 3130 restricts interrogatories plus a bill of particulars outside matrimonial actions. In the specified solely negligence-based injury actions, interrogatories plus a deposition of the same party require leave.
- Later amendment
- Section 3133(c) ordinarily requires a court order on motion to amend or supplement answers, with its express CPLR 3101(h) exception. The deadline does not authorize free amendment.
- Delivery and relief
- CPLR 2103 method additions and any CPLR 3103 protection require their actual conditions. This personal-service result assumes neither additional days nor a served protective motion.
