Which event starts the CPLR 3406(a) period?
Identify all named defendants and establish their actual joined-issue events. For a defaulting defendant, establish expiry of the applicable appearance, answer or motion period separately.
Use the final qualifying event after those requirements are satisfied for all named defendants. One earlier answer, complaint filing or the certificate of merit is not automatically that trigger.
Responsible actor. The plaintiff in the qualifying medical, dental or podiatric malpractice action. The Supreme or County Court malpractice notice under CPLR 3406 and rule 202.56, after the all-defendant joinder/default-expiry condition is independently established. No disputed response expiry, different order or granted late-filing leave is assumed.
CPLR 3406(a)How is this service or filing period counted?
- Identify all named defendants and establish their actual joined-issue events. For a defaulting defendant, establish expiry of the applicable appearance, answer or motion period separately.
- Use the final qualifying event after those requirements are satisfied for all named defendants. One earlier answer, complaint filing or the certificate of merit is not automatically that trigger.
- Exclude the established event day and count 60 calendar days forward. Intermediate weekends and public holidays count. General Construction Law 25-a permits the next succeeding business day for a closed final statutory day.
- File the prescribed notice and required attachments with the appropriate clerk, and serve the notice simultaneously on all other parties. An unassigned action also requires the rule 202.56(a)(2) request for judicial intervention.
General Construction Law 20 excludes the established event day. Intermediate Saturdays, Sundays and public holidays count in these fifteen-, twenty-, sixty- and 120-day calendar periods. Section 25-a permits the next succeeding business day for a closed final statutory day and expressly includes a period before which an act is required. The backward notice-to-admit boundary still requires the actual trial date and separate opening condition.
The independently derived 2026 and 2027 calendar follows General Construction Law 24 and Election Law 8-100. It includes Lincoln’s Birthday, Flag Day on the second Sunday in June, Juneteenth, general election day and the other specified holidays. Section 24 adds the next day when a listed holiday falls on Sunday, except Flag Day. A Saturday holiday is not automatically observed on Friday under this provision. Additional appointed holidays and actual court or system closures require separate proof.
These calculators cover established events and final dates within January 1, 2026 through December 31, 2027. They require the disclosed statutory branch, independently valid service, no unsupported method addition, no different actual court order and no additional closure. The backward notice-to-admit preset requires an actual open-day trial date and an independently established opening condition. Earlier editions, the 2020 executive-order toll and dates beyond the retained calendar require separate review and receive no computed or paid date. This software coverage boundary does not establish that an actual act is late.

- All named defendants
- Rule 202.56(a)(1) specifies joinder by all named defendants, or expiry of a defaulting party’s time to appear, answer or move. Resolve the last qualifying event rather than using the first answer.
- Required papers
- The rule identifies service proof, demanded record authorizations, initiating papers and pleadings, the certificate of merit if required, a served bill of particulars and the stated arbitration and expert materials when applicable.
- Simultaneous service and later materials
- Serve the notice simultaneously on the other parties. The rule separately addresses later availability of the stated bill, arbitration and expert information when those materials were initially unavailable.
- Unassigned action
- Rule 202.56(a)(2) requires a request for judicial intervention with the notice when no judge has been assigned. Filing a bare notice does not supply that request.
- Late-filing leave
- CPLR 3406(a) permits extension only on a CPLR 2004 motion. Rule 202.56(a)(3) requires leave on motion and good cause for filing after sixty days. No additional days or leave are presumed.
